Former Supreme Court Justice John Paul Stevens has released a new book focused, in part, on "improving" the Constitution through amending the Second Amendment--by making the rights protected therein applicable only to a militia instead of the citizenry at large.
Stevens' book is titled Six Amendments: How and Why We Should Change the Constitution.
As written, the text of the Second Amendment is: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed."
According to Bloomberg Businessweek, Stevens believes recent court decisions--notably District of Columbia v Heller (2008) and McDonald v Chicago (2010)--placed too much emphasis on individual rights, rather than on what he believes was the Founding Fathers' primary goal: namely, to answer "the threat that a national standing army posed to the sovereignty of the states."
His solution is to amend the text of the Second Amendment so that it reads: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear arms when serving in the militia shall not be infringed."
In other words, the protection of the right becomes collective and is only protected for those serving in the militia.

I go along with your message, not all of your language. The first person to be downgraded to exile is Chief Justice Roberts who sold out the people of this Nation(not his) for a briefcase of money to deposit in the Bank of the Vatican on Malta. Roberts is the modern day Judas for the Statue of Liberty.
The book must have been written for the advance money. Even an idiot like Stevens knows that the chances of getting that wording into the Constitution are very very low.

My apologies for the rough language, but his statement angers me to no end, and I am sick and tired of his ilk, particularly those who know better but are determined to make me a slave.
This is great. A lefty former SCOTUS justice admitting that as CURRENTLY written the second amendment to the US Constitutions establishes an invididual right to bear arms.
He also has no clue on the definition of the word “militia.” If you are able to carry/use arms, you are in the militia already.

Plus, do they not look at those regions who can carry and lessor crime?
I'm only made it as far as a GED, but have read their writings that cleary state that people have the "right" to depend themselves, not just be part of a militia. I have never understood these so-called academics who don't have such a basic understanding of the Constitutional supporting documents that CLEARLY states such a right. What happens in their thinking?

The various state national guard units ARE NOT the militia addressed by the 2nd amendment. They are part of the standing army, controlled by the federal government.
- I believe Allen Dershowitz agrees that the 2nd Amendment is an individual right - he is usually an easy, relaxed and logical person to talk to or debate with on air.
- I recall talking with Dershowitz some years ago when Bob Grant was at WOR; Bob’s producer had me on speed dial for certain topics.
- I am on a lot of those archived tapes from WABC and WOR; the way to get on Bob Grant’s good side was to always start by asking who he was that day. (GET OFF MY PHONE!)
