The police might be able to detain you until you’re positively identified. They can usually do that by getting name, birthdate and jurisdiction you have your ID in, if you don’t have it on you. That’s happened to me before, and they check it out and verify it.

If you are open carrying then doesn’t the law give the police the right and perhaps even the duty and imperative to check your open carry permit???

Here in S.E. Michigan I've only witnessed one person openly carrying a firearm and it was in my local Meijers store.

The guy was a Sikh, shopping in the produce section with his wife. He was about 6'2", 240 lbs., thick bushy beard, wearing the traditional turban, a long white gown and sandals. Don't know what kind of a handgun it was but it was about the size of a Sig P-226, holstered in a black holster and held on by a thick black belt.

I mean, you could not miss seeing the firearm on this guy based on how he was dressed. And his size and looks alone were intimidating...........LOL!

They can ask someone to leave for no reason at all. So, even if the policy was posted (or not) they can tell you to leave. All businesses have have the right to order someone off the property.

My son showed a college registrar his passport and she refused to take in lieu of a birth certificate. He had to press the point and make her and her supervisor consult the regs. They are so used to laying down the law without question.

Yes, indeed ... they can check to see if you are entitled to do so, under the law. It just goes with the territory ... :-) ...

Well, they walked up and injected themselves into the situation...

I guess they could have refused constitutional, but that would have simply made the LEO escalate...

Put yourself in LEO shoes...someone walks up and refuses to show ID, you have no idea who you are dealing with and why would they not be willing to show an ID?

I know you are supposed to be innocent until proven guilty, but let's deal with reality here...a large percent of LEO could care less about your constitutional rights and long as they get to go home and polish their badges...they will dance all over them...

So, it appears, we must carry our “papers” now. Even if doing nothing wrong or even suspicious. Then again, being friends of the scary open carry girls could be considered suspicious, I guess.

Land prices are depressed, because we are beside a military base, Camp Lejeune, and the Marine Corps is downsizing. My 2800 square foot house is in a good neighborhood and is worth about $210,000. Prior to the housing price collapse in 2008, the house was worth $250,000. Prices will probably stay low for quite some time, because the housing market around here is flooded.

He obviously knew that, but it does not prevent him from asking for other ID that is preferred. Now, what you don’t want to do is LIE to the officer, because even if that is all that is necessary - if you say you don’t have it and you actually do have it on you, then you can easily get into a pile of trouble for lying to the officer,

SO ... no matter what you think, you better tell him the truth - or else exercise your right not to talk to am officer - at which point they’ll most likely detain you ... :-) ...

And with that right comes the obligation to post their politicians. I mean like “No shoes, not shirts, no service.” I do agree that concealed carry is better.

Agreed. The police can ask for ID and to do so under almost any circumstances. This guy was being firm but polite. I noted that at no point did he ask the girls to surrender their arms while he was talking to them. A “person with a gun” call, even from some excitable liberal with damp Depends, would also justify the backup showing with rifles. So nothing odd there either.

And the responding officer, who kinda looks like Dean Norris, by the way, never interfered with their 1st Amendment right to record the encounter. He did, however, tell the liberal loudmouth to move along.

I can understand him having an issue with the passport. I don’t imagine that they see those often in Marshfield, MO, so he probably doesn’t feel confident about determining whether or not a passport is fake. A driver’s license is a document he’s familiar with and he can probably spot a counterfeit with his eyes closed.

I think the cop got the feeling that these kids were playing a game with him and he was right —

If he asks for a DL and you have a DL but then give him a Passport instead, then he has the right to be a little upset.

Cops are used to reading DLs not Passports.
