The police say that they knocked and identified themselves

a) So what? Isn't it their responsibility to ascertain that he actually HEARD it before escalating.

b) So what? Criminals have been proven to be incapable of properly enunciating "POLICE!! OPEN UP!!"? So how can you put the citizen at risk so the citizen's employee can do his job? Why would the burden of making a wrong guess fall on a member of the wealth-CREATING sector as opposed to the wealth-CONSUMING sector??

Mr. Stewart fired 31 rounds

I'm surprised he got off more than three.

One just needs to go back and look at the changing definition of "law enforcement" in this country to understand how we got here.

At one time, "law enforcement" was literally just that -- apprehending a suspected criminal for the purpose of: (1) protecting him from armed citizens hell-bent on exacting their own brand of justice; and (2) ensuring that the suspect was afforded a trial by a jury of his peers. In most jurisdictions the law enforcement officer was outmanned and out-gunned by the armed citizenry of that jurisdiction, so he relied heavily on the respect and good will of these citizens to carry out his duties.

The whole game changed once "police officers" became commonplace in America, and the primary role of these officers was crime prevention rather than law enforcement. This seemingly subtle change created an implicit distinction under the law, between "police" and "civilians," that has no place in a free society.

This is a very good article that lays out the social and constitutional problems, with the exception of the author's swipes at Republican officials -- while completely omitting mention of Mayor Goode (D) burning down a city block in Philadelphia, Bill Clinton (D) and Janet Reno's massacre at Waco, and of course their Elian Gonzalez travesty, not even to mention all the dog and human shootings in their own homes that have occurred on Obama's watch.

I worked with a major metropolitan police department in one of the largest U.S. cities as a publicist some time ago. All the top brass were sent to Harvard's Kennedy School of Government for instruction in community policing, mentioned in the article, and it was very effective.

The family of Jared Francom should sue the police department for putting their loved one at risk rather than arresting him peacefully outside his job or the grocery store.

all police officers should be elected like sheriffs, that alone would fix the issue.

This is exactly the kind of response I have been waiting for.

A No-Knock-Warrant is, essentially, a home invasion, and was dealt with accordingly. 31 shots vs. 250.

12 against 1.

I think the guy did OK.

Problem is, he was pretty well wasted - falling asleep at 8:30pm - naked - still, he was able to mitigate the threat, despite his lethargic “buzz”...

If this happens only a few more times, then King George’s Dragoons will think twice about quartering themselves, un-invited, inside a Patriots castle...

I see the solution to this beginning at the state level, with “police demilitarization acts”, that strip police departments of military hardware, and give it to their county Sheriff for safekeeping.

Thereafter, if there is a need for any SWAT activities in that county, it will be carried out by the Sheriff’s office, not the local police.

The second part of these acts would be to require a judge’s written and specific warrant before any county SWAT raid is conducted. If they can’t get such a warrant, then they should not be doing it.

The third part of these acts is to review all actions of police and Sheriff’s office personnel subject to review by the state police, based on citizen complaints.

If the state police find against the local police or county Sheriff’s office, that they engaged in wanton property destruction, killed domestic dogs, threatened or terrorized citizens, etc., then their victims will be paid directly out of the state funds supporting that department, for actual damages.

That is, if they smash down the wrong door, they pay for it, the money being docked from state funds paid to that department. If they shoot a family dog, the purchase and previous veterinary costs will come out of their budget. If they drag a soaking wet, naked, teen girl out of a shower with a gun to her head, they also get to pay for her therapy out of their budget.

” No Knock” = they are ‘supposed’ to shout Police ! Search Warrant ! while at the same time breaching the door . Sometimes they forget the verbiage.

Not surprising the way cops act nowadays.

If they need to send half a dozen, armed to the teeth cops to kill Bambi in the middle of the night, no surprise there are more and more of these incidents and will be many more in the future.

Many LEO’s have become “gym rats” pumping iron to bulk up.

It is my opinion that “some” might have started taking Steroids to recover that lost youth.

I am a believer that “some” LEO’s have shown signs of “Roid Rage” and need to be tested after every police shooting.

Just my opinion. My dog agrees.

What’s next? Drones with missiles? The Gestapo police will be clamoring for drone strikes after a few more of their fellow Nazis are killed in these disgusting raids.
The Federal elites are setting up a war between citizens and the police. If some of the police have any brains left, they will resist the push for more militarization and attempt to regain the trust of the public. As I see it, if they keep this crap up, the police will become just as unpopular as the Feds and Congress.
