Why did Marissa Alexander get a 20-year sentence despite invoking ‘Stand Your Ground’?

Late Saturday evening, George Zimmerman was found not guilty in the death of 17-year-old Trayvon Martin. The issue of self-defense played a central role in Zimmerman’s not guilty plea and his defense’s argument against the second-degree murder charges, and his acquittal is drawing comparisons in the media to the verdict of another high-profile Florida shooting incident: the case of Marissa Alexander.

Alexander, an African-American Florida woman, was sentenced to 20 years in prison in 2012 for shooting what she described as warning shots into a wall during a confrontation with her husband. Alexander’s lawyers claimed self-defense in the case, and said her husband had a history of abuse in their relationship. They invoked Florida’s “Stand Your Ground” law, which gives people the right to use lethal force if they feel their life is threatened. The jury ultimately sided with prosecutors in deciding Alexander’s actions were not in self-defense, WJXT reported...

That’s why it makes me cringe when right-minded people try to get out of jury duty. We have the power to nullify a law.

You're not looking at who published this and what their agenda is. "Marissa Alexander ran out of her house into a garage to escape her abusive husband. Once there, she found that she did not have her keys and that the garage door was broken. She armed herself and went back into the house."

The Judge stated; “Maybe I would be agreeing to a new Stand Your Ground motion, which highlights some of the difficulties we are struggling with procedurally implementing this new law,” he wrote, “but ultimately the motion is denied.” In his opinion, Alexander’s decision to re-enter the house was “inconsistent with a person in genuine fear of his or her life.”

PMSNBC isn't giving the whole truth because it doesn't fit their agenda.

If you bother to actually peruse the facts she went out to her car, got her gun and came back in to "stand her ground."

That ain't SYG. That's premeditated assault.

He was freed from jail pending a new trial over a year ago. Corey’s office has yet to decide if they will prosecute again. Better?

She had a restraint order against her husband yet went to his residence and started a fight. Big difference in the two cases.

That’s a local story for me.

1. Not the same thing as Zimmerman at all. She went outside, got the gun, and then came back. That is by definition NOT stand your ground material.

2. She’s stupid with priors. I think she was baby momma #6 for the male idiot involved. Stupid never helps, and priors most certainly don’t.

3. She was overcharged by the same moronic prosecutor that went after Zimmerman. Hardly any of the same FReepers who would have shot Trayvon if in Zimmerman’s shoes, would have given this woman anything more than a slap on the wrist.

4. I think she had a public defender and unfortunately, money matters in our criminal justice system.

"Once she was out, she wasn’t in danger any more. Running BACK to danger is what made it something other than “stand your ground” or “self defense.”

Kind of like TM running away to safety, then doubling back to punch and pummel GZ.

Exactly right. The analogy would be if Zimmerman escaped from Martin’s attack, returned to his truck, grabbed his gun, and then went back after Martin.

yeah, she became a willing participant at that point by re-engaging, and she also escalated it, and potential problems because she didn’t know what was behind the wall, if the kids were in the line of fire.

This case is a lie through omission of critical facts.

1. The woman had TRO out against her ex-husband.
2. She went to her ex-husbands house, found him there with the children.
3. An argument ensued.
4. The woman went out to her car, retrieved her weapon and came back and continued the argument.
5. She fired the so-called warning shots.

So, she violated her own TRO by either knowingly going to her Ex-Husbands house while he was there, or not leaving immediately when discovering he was there. She participated in an argument with him, then left the perceived danger to fetch a pistol, then came back and shot in his direction.

That’s not stand your ground nor self defense, that’s attempted murder. Even so, I do not agree with the mandatory sentencing, but this women was hardly innocent.

Angela Corey, who oversaw the prosecution of Zimmerman, also tried the case against Alexander, and defended the sentencing at the time.

Angela Corey has a history of vindictive prosecutions. I am for strong punishment but Corey seems to have a big sadistic streak in her.
