That's not going to happen. The HOA, and / or their insurance carrier, got spooked by the publicity and settled of their own accord. That cannot be undone. They could have drug it into court, awaited the criminal verdict and more than likely been absolved of any liability from a civil perspective. They rolled the dice - they made a bad bet.
