I’m sorry about that post that I accused you of making when it was Whoraldo that made it. I’m sorry I said that no one should listen to you. Looking back you have made some very good observations about this trial. I was wrong to say that.

Now on the issue of why GZ got out of his car, you may think that is the key to a conviction and maybe the jury will come to the same conclusion you did. But it is not relevant to the charges. The only thing that is legally relevant is the state of mind of GZ when he fired the shot. Not when he got out of his car.

Any reasonable person would have to believe, based on the evidence presented, that GZ was in fear of great bodily injury or death at the time he fired the shot.

I think the defense team should have emphasized the fact that GZ would be in obvious fear that if he were to have been knocked unconscious that he would have to assume that TM would have taken the gun and used it on him. That’s what would have gone through my mind. It was kill or be killed at that point.

The point is that no whatever went on before TM hit GZ in the nose is irrelevant. Even if we assume ill will going into that moment, it is a defense to both charges if he believed at the moment he pulled the trigger that he was in reasonable fear of great bodily harm, them be is not guilty.

Once again I apologize for my stupid remark. I was wrong. I’ve been wrong before. I’ll be wrong again.
