Today, July 11th, is DAY #23 (of 5th week) State of Florida V. George Zimmerman case.
Yesterday the defense rested its case. A legal analysis via Professor Jacobson HERE.
From my perspective the entire case ended, as expected, early in the day yesterday when Judge Nelson gave George Zimmerman his personal Platinum Express DCA Acquittal Card. The ruling, and more importantly the legal determination she used on the ruling, regarding the Trayvon Martin phone evidence was an immediate Nuclear DCA option. Nelson essentially ruled against admissibility based on authentication. She could have kept it out under other legal reasoning, but no, she chose the one without the slightest chance of being upheld by a District Court of Appeals. IMHO this was intentional and aligns itself with the way she has ruled during the pre-trial discovery phase, and during the case itself. Shes a rigid ideologue, but shes not stupid this was intentional.
By ruling the phone records (texts and pics from Trayvon) cannot be authenticated to have originated by the specific personage of Trayvon Martin just gave the dismissal of the case to George Zimmerman with a bow on it.
As it was carefully explained to me, the phone is like a bucket. The data inside the phone is like marbles in a bucket. Some marbles from calls, others from pictures, others from texts, etc. The State brought the bucket into court and validated the bucket contents with their own witness from the phone company Both the State and the defense then began arguing their case around the phone call marbles in the bucket Primarily with Rachel Jeantel. But no-one challenged the bucket itself. The State authenticated the bucket and the content of the bucket during the introduction.
The defense picks up the same bucket the state hands them, and now begins to use the contents texts and pictures and then Nelson rules the bucket itself cannot be authenticated. It doesnt work that way.
If the state authenticates evidence, it cannot be divided and only authentic when the state holds it, but not the defense. Flawed logic ABSOLUTELY positioned to give such a prejudicial outcome, the appeal would result in dismissal, not retrial. Nelson gave the case away to George Zimmerman.
She could have ruled on relevance, admissibility, or other factors but she chose the one destined to fail, authentication. She gave it away.
In other news, people are catching on to the Eric Holder, Department of Justice, Civil Rights Division, Community Relations Service being the actual puppeteers behind the entire construct of the false case. To them we say welcome to the party pal.
History books may not include George, but he is a real American hero.
He has lifted my spirit because of his devotion to justice and doing the right thing for his community (and I plan to write a letter to him expressing my thanks and support...and if he loses this trial I will send him all the cash I can afford).
George has been call a "wimp" basically because of his lack of athletic ability...but he is my hero. He has done more that I have ever imagined I might do.
If he goes to prison, I will visit him often.
George is a hero in the new style. He stuck his neck out for his community...and he was chastised by those who should praise him.
I hope George knows, God is with him!

I think the forensic evidence clearly shows Trayvon wasn't holding the slide when the gun was fired, since the insides of his fingers were intact. Limp-wristing would seem to be a more likely contributor to the malfunction, though I suspect that an "overloaded" gun would require somewhat more energy to cycle than one containing fewer rounds.

How wide is the door open? For example, could the defense attorney say "Even though the prosecutor describes Trayvon Martin as an 'innocent teenager', he hasn't presented any evidence of Trayvon's character beyond the fact that he likes to fight and his father expected to find him in Juvie." Could he go a little further, and suggest that the prosecutor has "declined to call any witnesses that might attest to his character"?
Well come on down...we like dark meat down here (but only with a some chianti and fava beans)...and what we don't eat the raccoons, possums, and gators eat.

I have owned and lived in my house for 33 years now. I live on a court. I can tell you what main road leads to my housing area, and the street onto which I turn to get to my court, but I can’t tell you any other streets or courts that are one, two, three or more blocks from me.
That’s why it irritates me when Bernie brings up the fact that George did not know the streets in the housing area.
George Zimmerman’s pistol failed to chamber the second round. He only had one shot, as it turned out, and he was SOL if he had needed another. The found the brass for the first round on the ground, but the chamber was empty. There was conjecture at the time Traydemark caused the rack to fail to slide, but that was disproved.
It’s a mystery why the second round failed to chamber.
This one looks kind of stringy, but I know of a 14’ gator that could use a meal.
