Today, July 11th, is DAY #23 (of 5th week) State of Florida V. George Zimmerman case.
Yesterday the defense rested its case. A legal analysis via Professor Jacobson HERE.
From my perspective the entire case ended, as expected, early in the day yesterday when Judge Nelson gave George Zimmerman his personal Platinum Express DCA Acquittal Card. The ruling, and more importantly the legal determination she used on the ruling, regarding the Trayvon Martin phone evidence was an immediate Nuclear DCA option. Nelson essentially ruled against admissibility based on authentication. She could have kept it out under other legal reasoning, but no, she chose the one without the slightest chance of being upheld by a District Court of Appeals. IMHO this was intentional and aligns itself with the way she has ruled during the pre-trial discovery phase, and during the case itself. Shes a rigid ideologue, but shes not stupid this was intentional.
By ruling the phone records (texts and pics from Trayvon) cannot be authenticated to have originated by the specific personage of Trayvon Martin just gave the dismissal of the case to George Zimmerman with a bow on it.
As it was carefully explained to me, the phone is like a bucket. The data inside the phone is like marbles in a bucket. Some marbles from calls, others from pictures, others from texts, etc. The State brought the bucket into court and validated the bucket contents with their own witness from the phone company Both the State and the defense then began arguing their case around the phone call marbles in the bucket Primarily with Rachel Jeantel. But no-one challenged the bucket itself. The State authenticated the bucket and the content of the bucket during the introduction.
The defense picks up the same bucket the state hands them, and now begins to use the contents texts and pictures and then Nelson rules the bucket itself cannot be authenticated. It doesnt work that way.
If the state authenticates evidence, it cannot be divided and only authentic when the state holds it, but not the defense. Flawed logic ABSOLUTELY positioned to give such a prejudicial outcome, the appeal would result in dismissal, not retrial. Nelson gave the case away to George Zimmerman.
She could have ruled on relevance, admissibility, or other factors but she chose the one destined to fail, authentication. She gave it away.
In other news, people are catching on to the Eric Holder, Department of Justice, Civil Rights Division, Community Relations Service being the actual puppeteers behind the entire construct of the false case. To them we say welcome to the party pal.
“...I think I have some anger management issues re: Bernie and his pals.;-)”
You’re in good company there! And ditto that.
They had the trial on TV, but turned off when I walked in, very professional.
Then made negative comments about “Obamacare” -— I tried to keep my political opinions to myself.
Pleasant, professional Black couple.
I made the sale.
I hate this trial, I rarely ever make note of anyone’s color. I hate the poison that Obama and the Media have brought.
I lurked it. Geesh.
Thanks for providing the thread uncle chip. I’ve been following somewhat, and tune in here when I get home from
work. One thing I’ve always wondered about, is, why is
George Zimmerman’s wife Shelly not sitting behind him?
Or is she and I don’t know who she is.
Did you happen to notice if there were multiple people using the same terms and phrases, like they were working from a prepared script or list of "talking points"?
Please ..
Would someone synopsize for me?
Apologies and thanx
I was assuming that if there is a retrial, the phone records would be admitted after verification.
Hey Kansas. ‘Sup? They had it on the TV? In Kansas?? Sigh. You handled the Obastardcare stuff adroitly. Glad you made the sale, that’s all that really matters.
Obastard has done nothing but pour poison down the well by the barrel.
I can completely understand that. Since the GZ trial, my drinking has taken a great leap forward.
If GZ is acquited, I will go on the wagon for the next six months.
If he is found guilty, I may keep drinking and go back to law school.;-)
As long as I am drinking, I may as well have a reason for it.
You sayin’ my ears ain’t delicate pal!?? jk
I’m having trouble controlling my anger at this whole horrible mess, too.
Awesome news about the $$!!
Bazinga!
Port Huron (Actually Lakeport - Burtchville Twp) was just a meeting spot for the 60's leftists which were more active at the college areas like Wayne State (part of Detroit), Ann Arbor, and East Lansing. Romney won every Burtchville Twp precinct. That's up in the Thumb anyway which isn't the Detroit area.
Reality today is like "Invasion of the Body Snatchers" come to life.
“I was assuming that if there is a retrial, the phone records would be admitted after verification.”
Oh. If there had to be another trial, no doubt that Defense would get that evidence authenticated. Ergo, why there probably won’t be another money-wasting trial IMO.
Shelly and George’s parents were not allowed in the courtroom because the state put them on their list of witnesses that they MIGHT call to the stand but never did nor ever intended to. They did that just to keep them out of the courtroom.
They were back in court today for final arguments and will be tomorrow. Shelly is the blond who sits in the end of the 2nd row far right closest to George.
Big storm last night, lost all power at 6PM Eastern ... JUST NOW BACK ON ..
Please ..
Would someone synopsize for me?
Want some? But you CAN’T HAVE THE TORTELLINI!! Or the crackers.
I don’t drink much usually. I do like sparkling wine and ice cold Corona with lime. A couple of gin and tonics, gin martinis, etc., and that’s it for me. But yeah, the frustration over this damned trial might break that trend for me...heh.
Thirdly...the cops rolled him over, did CPR including mouth to mouth and compressions. No photographs were taken of the hands...
Put a splash of Cuervo Margarita mix in the Corona instead of the lime. Mmmm good!
Don’t forget the Brussel sprouts AKA BS ??
