I have been doing some thinking...how can you prove it was Trayvon sending those messages??? Didn’t he say he got suspended and had to move with his dad? That can be proven by dates. Also, whoever he was talking to may have answered him by his name in the return text msgs.

Seems to me, if the state (and judge) doesn’t want the evidence heard, they should have to prove that it was NOT Trayvon using his own phone. It’s not like it would be that difficult. They know how damning this evidence will be though.

Like West said, one way is to correlate dates and times with known events. Another way is to track down the recipients and bring them in as witnesses (and subpoena their end of the conversation).
The law the Judge read also speaks to “circumstantial” authentication. I would presume that would entail showing such things as: no one else ever sent a message; the language of the messages was consistent with other communications by TM; and so forth.
But it takes TIME to do all of those things. Time that the prosecution screwed the defense out of by giving them the data late in the game; and time that the judge did not make up by granting the defense more time to prepare for the trial.
