Not really breaking. It was highly anticipated, probably correct since the state has failed to make a prima facie case. But if you've followed the judge's behavior, she's clearly on the side of the prosecutor -- so much so I think there are reversible errors already -- and she isn't going to do it however correct it might be.

I think it’s pretty much malpractice if you don’t ask at the end of the prosecution’s evidence in every trial. This one deserves it to be granted.

Motion for dismissal is normal procedure for a contested case, but it is uncommon to be granted. Judges usually wont take it out of jury/deliberation, even when there is a strong case for not wasting anymore time and taxpayer money on bunko cases.

It seemed like the prosecution had given up and just wanted to get on with finding Z innocent and let the riots begin. The prosecution certainly didn't seem like they had a case.

What?! It’s too early in the season to end this show (trial). More time is needed to prep for coverage of the riots. Summer TV schedules have already been locked in. The network news talent is on vacation. Which programs will be preempted to make room for the riot coverage? Oh well, at least the riots might boost ratings, during the slow summer season.
(Was I being sarcastic or sardonic? I can never tell.)

I know of a civil case where at the close of plaintiff’s evidence, the defense attorney was preparing to move for nonsuit.
The jury was still in the box when he stood up and said “Your honor, defendant X would like to make a motion at this time.”
The lady judge, without hearing any law or argument, or even missing a beat, simply said, “That motion is denied.”

It's my understanding that this is SOP.Given that this judge has proven herself,beyond a whisper of a doubt,to be working for the prosecution she's far more likely to declare GZ to be *guilty* from the bench than *not* guilty.
