This argument is available to anyone who wants to defend data mining—that only when relevant info is extracted from the big DB does the 4th amendment clock start ticking.

By the same argument, you could search every house in America looking for one suspected criminal and remain within the framework of the 4th.

You are right. It was frightening to see LE order people out of their houses at gunpoint, frisk them, then search their houses. Good reminder.

If the phone mining worked, why did they spend a week trying to find the Tea Party terrorist when a phone detonated the bomb?

The reason is they were not looking for Islamic terrorists.
