ACLU Believes Boston Bombing Suspect Should Be Read His Miranda Rights First

Statement by ACLU Executive Director Anthony D. Romero on Miranda Rights of Boston Bombing Suspect Share

The American Civil Liberties Union reacted to the apprehension of the suspect in the Boston Marathon bombing and statements from federal officials that he would be questioned without being read his Miranda rights.

"The ACLU shares the public's relief that the suspect in the Boston Marathon bombings has been apprehended,” said Anthony D. Romero, ACLU executive director. “Every criminal defendant is entitled to be read Miranda rights. The public safety exception should be read narrowly. It applies only when there is a continued threat to public safety and is not an open-ended exception to the Miranda rule. Additionally, every criminal defendant has a right to be brought before a judge and to have access to counsel. We must not waver from our tried-and-true justice system, even in the most difficult of times. Denial of rights is un-American and will only make it harder to obtain fair convictions.

"Our thoughts remain with the victims of this tragedy and with the entire Boston community."

You are correct, and I am no fan of Miranda, but you do have to deal with the reality of the Supreme Court decision. The issue is what evidence becomes admissible at trial.

I don’t care, I don’t believe Miranda rights are legitimate required in most states. (It certainly says nothing about that in the Federal Constitution, although if public schools did their job it wouldn’t matter, Instead of focusing on indoctrinating leftist propaganda on the defenseless minds of little kids) But I don’t care if Massachusetts wants to baby the terrorist.

I really do want to know what this guy knows, where his friends & supporters are ect.. but I’m not positive about him telling us to the truth anyway.

I will get clobbered but he had citizenship, so yes, I think he should be read his rights.

If they can do it to him, they can do it to the rest of us.

Most americans know the Miranda. If you watch any TV in this country you have seen someone read their rights!
It doesn’t matter what his rights are. There are eye witnesses to the crimes he has commited!
Ironically one Charge could be Manslaughter for killing his own brother, if autopsy confirms death by vehicle.
Yes he deserves his day in court and will prob out live
most of us freepers at this point and some or most of the injured lives he created!

Well, I think there should be gallows in America. I think ACLU members should swing from them, and then they can exercise their free speech.

Miranda Rights are recent “rights” that did not exist until, when, 1960s(? go ahead look the date up, so you can call somebody ‘stupid’). Follow your logic all you Miranda Rights advocates here and elsewhere with your deep thoughts, does that mean that until then America was a unjust fascist dictatorship?

Absolutely boneheaded not to read him his rights...gives his future scumbag lawyer a reason to overturn anything they find out...read him his rights - then torture him.

Nobody suggests not reading him his rights (at least I don’t read that), only that it should not be an overriding concern. In fact, what if his rights were not read to him, what would the public reaction be if he were then let loose? Maybe, just maybe, the country would get over this obsession with rights for criminals. One can dream.

Yes, he should be read his rights. I would guess he’s aware of his rights anyway, so what good does not reading them do? It just endangers the prosecution.

Also, a good lawyer would realize that the best thing for his scumbag client might be to tell everything he knows to save himself from the needle...
