A judge Monday overturned Mayor Bloomberg's controversial ban on large sugary soda, one day before the regulation was to take effect.

Manhattan Supreme Court Justice Milton Tingling Jr. declared the ban “arbitrary and capricious,” agreeing with several soda and business groups that had challenged the prohibition in court.

The ruling was a stinging setback for the mayor, whose administration enacted the regulation in the face of criticism that he was turning the city into a “nanny state.”

The Bloomberg-backed city Board of Health approved the regulation last year, calling it a crucial tool to attack obesity. The rule forbid restaurants and certain other businesses from serving sugary sodas larger than 16 ounces.

Willing buyer - check.
Willing seller - check.
No direct harm to others - check.

If 17 ounces is bad, isn’t 16 ounces bad, too? And 15 ounces?

Next he’ll go after white bread.

No, it’ll be a restriction on the number of falafel balls you can in between a pita, on your salad or just plain with hummus.

No more than four per serving.

Why not go after how many ice cubes you can have in your soda. Yay, it’d be just like drinking Coke during a heat wave in France.

good ruling

It is, but having been before Judge Tingling some years ago (and having had a few cases against him when he was a lawyer for the City), I can tell you that good rulings from him are few and far between.

Doomberg will still be dangerous, perhaps more so, after he leaves office. Soros will eventually die and I have no doubt that Doomberg, will take his place, funding fascist mayhem everywhere.
