Judge tosses Mayor Bloomberg’s ban on large sugary sodas one day before it goes into effect

A judge Monday overturned Mayor Bloomberg's controversial ban on large sugary soda, one day before the regulation was to take effect.

Manhattan Supreme Court Justice Milton Tingling Jr. declared the ban “arbitrary and capricious,” agreeing with several soda and business groups that had challenged the prohibition in court.

The ruling was a stinging setback for the mayor, whose administration enacted the regulation in the face of criticism that he was turning the city into a “nanny state.”

The Bloomberg-backed city Board of Health approved the regulation last year, calling it a crucial tool to attack obesity. The rule forbid restaurants and certain other businesses from serving sugary sodas larger than 16 ounces.

This ruling is a much needed victory. The thought that a government official would authorize legions of inspectors with 17 oz measuring cups to check the quantity of drinks given by retail establishments is George Orwell territory. I knew when they started regulating tobacco use that food would come next. I knew that the job of regulating was a Big Government industry requiring continuous expansion using the tax payer’s life energy. They work like a parasitic organism. These Big Government tyrants do not stop. They are a one trick pony with hell to pay. I hope some day we will look back at these idiots in the ash can of history.
