New legislation in the Texas State legislature, sponsored by Steve Toth (R-Dist. 15), looks to stop Texas law enforcement officials from confiscating so-called “assault weapons” and high capacity magazines. The legislation is called the Firearm Protection Act.
Toth’s proposal would create a Class A misdemeanor for police officers enforcing any new federal gun regulations. It also would establish cause for the state attorney general to sue anyone who seeks to enforce new federal gun regulations. It is one of several states-rights measures being offered by conservative state lawmakers nationwide in response to federal gun control proposals.
“There’s a federal law, there’s a 30-round magazine right in front of you – what do I do?” Toth said in an interview.
Toth, in a press release, wrote, “The ‘Firearms Protection Act’ or HB 1076 would make any federal law banning semi-automatic firearms or limiting the size of gun magazines unenforceable within the state’s boundaries. Any municipality, county, or special district trying to enforce a federal gun ban could face monetary holdings by the state and misdemeanor charges under this proposal.”
According to Toth:
The ‘Firearm Protection Act’ would do the following: • Supports and protects our local sheriffs and law enforcement officers working hard to protect Texan’s 2nd Amendment Rights • Sends a clear message to Washington by supporting and protecting Texans from the Federal Administrations unconstitutional overreach • Addresses local Texans concerns for their personal safety
“I believe this administration has now realized they have woken up a giant. All over the United States, Americans are crying out for something to be done to protect their 2nd Amendment rights. The American people understand this is not just about gun rights, but about all constitutional rights. They understand once you compromise one Constitutional right, all others can be in jeopardy”, said Representative Toth.
Sheriff Richard Mack, a former Arizona sheriff said, “”The federal government is not our boss. If there’s any place that that’s applicable and true, it’s the state of Texas.”
Attorney General Greg Abbot helped draft the bill. Along with Abbott, who has already filed over twenty-three suits against the Federal Government, Representative Toth will continue to stand with other Texans to encouraging the promotion of personal responsibility and liberties while actively guarding against outside parties attempting to erode the freedoms enjoyed by Texans so that the people of Texas may have more confidence in their government.
Well, it's the people who make the character of any state.
John McCain would have been sent packing a long time ago if he'd been a Texas Senator. We got rid of Kaye Bailey Hutchison and sent Ted Cruz to the Senate in her place.
Of course, Texas isn't perfect. A good number of abominable rat bastards are from here, too, but it's not we conservatives who sent them to Washington.

I expect the feds will be even less happy with Texas if it does pass, which is perfectly fine with me. They can shove their anti-constitutional tyranny right up their you-know-what, for all I care.

I came down from Oklahoma. I’ll never forget 7th grade Texas History class. We had to memorize and recite Col. Travis’ “To All Americans in the World” letter from the Alamo.
I cried. As a 13 yo male, that was harsh. My native buds kidded me for months. Now, as a mature man, I have no regrets.
There is something special about being a Texican, or Texian, or whatever we call ourselves. I didn’t be born here but if I sing my song of death here at some point in my history, you may all know it was a good day to die.
As Col. Crockett said “You may all go to hell, I’ll go to Texas.”

As an Army brat, it seems I grew up in a hundred different places. All but the great state of Texas. For some reason, Dad was never stationed here during his career, so I only came to know the place after I had my own kids.
In 2005 I’d finally had it with the decline in California, and crossed the mental Rubicon of seeking greener pastures elsewhere. Friends on the net suggested that I give Texas a look. The wife and I came down to see for ourselves, and we knew right away that it was the place for us.
I was very happy with our decision, and only regretted having to leave our extended family behind, but at the time, I had no idea what a wise choice we’d made. I only came to appreciate that, after having lived here a number of years.
The proof in the pudding, is that I’ve never gotten homesick for California. Not even once.
Texas just might just be the State that saves America from the communists empire it is becoming.

I'm certain that it will be. I've felt it in my bones for many years now. I do know that for better or worse, it's become the agreed-upon last ground of refuge and rallying point for real Americans.
Thank God I had the good sense to get my family here some years ago.
I’ve heard rumors that the ATF and FBI are recruiting local law enforcement who are willing to help.
That is a valid and legitimate viewpoint that I too have long held. If Obama wants to pick and choose which laws to abide by or to ignore then what's good for the goose is good for the gander.
The net end result is Anarchy.
So we may yet see the ‘blues’ and the ‘grays’ fighting each other in a civil war , again.

Obummer sure kicked a hornets’ nest with this gun issue. He should have let this sleeping dog lie.
Every state seems to have a wildly different approach to firearms, from talk of confiscation to plans for arresting federal officials. It’s near impossible to keep track of what your own state is doing, let alone neighboring states.
I can’t shake the feeling that the (mostly but not entirely useless) U.S. Supreme Court will be stepping into this gun-grabbing debate in a big way, and soon.
Yes, there is much to admire about Texas, and it’s support of citizens’ rights to own guns is one of them.
But let’s not forget the growing demographic problem in the state. Thanks to unending mass immigration, the state is becoming ever more Hispanic and less white. That means less Republican and more Democrat. Yes, I know, the GOP still dominates the state, but that is due to the party’s ability to routinely win over 70% of the white vote. That the GOP does a little better with latinos in Texas than they do in California is nice, but not that significant. The important thing is that the GOP is still losing the Hispanic vote in Texas, and the Hispanic vote is growing. If Rubio and Obama pass their amnesty and huge increase in legal immigration, then the situation will only get worse.
So how much longer will 70+% of the white vote guarantee victory in the Lone Start State? Don’t be surprised if Texas becomes a battleground state in the 2020s, if not sooner. Don’t be surprised if that execrable mayor of Houston wins a statewide race sometime down the road.
I hope I’m wrong, because Texas is of vital importance to the country. Without its electoral votes, the GOP’s shrinking chances becomes almost non-existent. But demographics is destiny, and despite the garbage put out by people like Rove, Rubio, the Bush family, and on this point even the otherwise admirable Cruz, that Hispanics are natural conservatives, it just isn’t so. As evidenced by their actual voting record, and polling showing their support for Obamacare and gun control, Hispanics are a natural Democrat constituency.
I don’t think Texas will suffer California’s fate so long as the white population in Texas remains conservative. That isn’t the case in California, and is a huge reason why the GOP is irrelevant in that state now. But in Texas, whites vote like whites in Southern states, and that may be enough to keep the state purple at least.
They may, and if they do, I expect them to craft their ruling in a way that seeks to head off or avoid a second revolution.
If they rule for infringement of the 2nd Amendment, they may as well hang up their robes on the way out of the courthouse, because their days as Supreme Court Justices will be numbered. As will those of every officer, appointee, employee, and elected official of the federal government.
This issue is hotter than the surface of the sun.
