Actually, he is. There's nothing Constitutional about our drug laws.Until the SCOTUS says otherwise,they're presumed to be Constitutional.

Until the SCOTUS says otherwise,they're presumed to be Constitutional. If they are presumed to be Constitutional, SCOTUS will never say otherwise. SCOTUS saying otherwise has to start with someone challenging whether the law is constitutional. To do that you first have to throw out the presumption that it is constitutional.

"Presumed" for purposes of legal proceedings, perhaps - but no true conservative would let the court that has repeatedly upheld Roe v Wade decide for him what's Constitutional.
