PhoenixIn a strong rebuke to the Obama Administration Wednesday, federal district court Judge Frederick J. Martone ruled that the Secret Ballot Amendment, which protects workers right to secret ballot in union-organizing elections, is constitutional.
Drafted by the Goldwater Institute in 2009, the Save Our Secret Ballot amendment was added in 2010 to state constitutions in Arizona, South Dakota, South Carolina, and Utah, by voter majorities ranging from 60 to 86 percent.
The constitutional amendment was sought after President Obama and congressional Democrats attempted to end the use of secret ballots in union-organizing elections and force workers into a system called card check, which would make it easier for unions to organize and open up the system to abuse by union organizers.
Todays ruling is a huge victory for federalism and the authority of states to protect the rights of their citizens, declared Clint Bolick, Goldwater Institute Vice President for Litigation. In the backdrop of continued power grabs by federal agencies like the NLRB, this ruling affirms that vital protections such as the right to secret ballot can remain in place.

Wow, all kinds of judge happiness coming from Arizona today.
Wake me up when the revoke the “right” of collective bargaining and people can voluntarily contract to work or not work with whomever they want.
I wonder if this ruling came AFTER Gangsta-thug mobster Trumka’s speech today. LOL
good news
secret ballot is bedrock of freedom in a democracy
This is still just leaving the ball where it is, we still have to push them back somehow
The American communist party takes another one in the shorts.
You’re right and that won’t happen until the turkey in the WH is gone.
Guess we folks in AZ aren’t so dumb after all.
I think the Dems downfall in 09 began when they somehow couldn’t pass national card check, despite having legislative control and the POTUS.
That was the real key to unionizing tens of millions of jobs and providing perpetual re-election to Dems.
Ubama and his rat thugs, slapped down again!
“good news” fur shure! “NLRB loses!” but NRBQ wins!
A win for both business and the American people.
Divine intervention! You can see it everywhere!
I take it you have a problem with the right of free association.
The problem isn't unions, it's union monopoly. Employee-owned companies marketing an array of skilled labor in a free market is a good thing.
Work to amend the NRLA and stop your pining.
A nice bit of good news amidst the crazy.
Check your definition of “Right”!! What gives anybody the “Right” to collective bargaining?
When push comes to shove, as I believe it must, Arizona and Texas will be in the forefront defending this Republic.
