anyone know if this comes under the libel law? There seems to be malice behind the accusation...
A Senator and Representative,when speaking from the floor of the Senate or House,is immune from all charges of libel/slander,etc.Of course,such individuals just might be subject to certain felony charges related to the unauthorized dissemination of a private citizen's tax records.
Reid has carefully made his statements on the Senate floor, or in his office inside the Capitol Building.
It could be libel, but it's not actionable.
Besides, Romney wouldn't sue Harry over it anyway ~ several reasons ~ (1) discovery ~ Romney isn't likely to want to defend his tax filings in court, (2) they are brother Mormons ~ who are expected to resolve disputes among themselves and not bother everybody else with their problems, (3) Romney wants to be President and Harry already is Senate majority leader ~ big jobs for big men eh? Or at least they want you to think that way. A trip to the courthouse with a petty matter like this is probably not in the cards.
These things, BTW, used to be settled in DUELS. Frankly, it's time to reconsider that practice as an option.
A senator can say anything he wants on the senate floor and not be charged with perjury or libel. I’m not sure he can say ANYTHING about another senator. There may be rules concerning attacking each other.
The biggest problem with this “plan” is relying on McCain. Now that’s rich.
What needs to be done is another senator pulling a Hillary and standing up before the senate and holding up a copy of the 2007 LA Times about Reid accepting a bribe.
What Romney really needs to do is walk into Reid’s office with cameras rolling and tell him to take it back or Romney’s going to whip his ass until he wets himself then he’s going to cut all off all his hair. That would make me vote for Romney without question.
