I agree. IIRC your Supreme Court ruled that the “fire” scenario is not a free speech issue because it is not speech, but incitement, and incitement is an action. That goes back to our common English Common Law heritage, which to this day is a recognized part of my country’s Constitution (most of Canada’s Constitution is unwritten, based on precedent from English Common Law and the Napoleonic Civil Code).

You are right that we are improving on gun rights, but vis-a-vis 1st Amendment there is also good news:

1. We never had the bogus church/state separation, so there is not nearly as much trouble about displays of faith in the public square.

2. The worst violation of free speech, section 13 of the Human Rights Code, is in the process of being repealed.
