I agree completely! I think Justice Roberts did us a BIG favor by demanding that the Democrats defend this monstrosity in public before the November election.

There is nothing noble or good in Roberts decision. He betrayed us and the Constitution.
And I agree about feeling powerless. I live in Alabama and both my senators are Republicans. Granted one is more moderate than the other but both are way right of Obama. And I will probably hold my nose and vote Romney. That’s all I can do. Vote, simmer, stew and gripe. And take it. They are just going to do whatever they want.
It does make me feel helpless and powerless and that makes me angry.
And now he has his legacy, the “Roberts Tax”.
That's the right argument, but for a different legal action. For the U.S. Supreme Court to take up the hypothetical case you describe, the legal action would have to be brought by a plaintiff who suffered harm because he was taxed in this manner. No such plaintiff exists in this case (yet), because the mandate hasn't taken effect yet.
This particular Federal case only involved the legal action filed by the Attorneys General of those 28 states. It was, by definition, a very "hyopthetical" case because none of the applicable ObamaCare provisions that were under dispute has even taken effect yet.
Heck, I would even suggest that these legal challenges were filed prematurely -- because there's always a possibility that ObamaCare could be altered, overturned, or completely de-funded by Congress before anyone is ever subject to these individual mandates.
I wonder if Mark Levin has any take on this. I love the guy's legal analysis, but there are a lot of legal angles to ObamaCare that haven't even been brought into the cold light of day yet.

Yes you are. Roberts had the knife to the throat of this crap and he let it free. Whether it was an ultimately academic exercise in limiting the Commerce clause or a desire for the Court to appear non-partisan, the idiot chief justice crippled our liberty. Thanks justice Asshole!
None of you actually believe a liberal court would avoid going for the jugular on conservative legislation do you? See gay marriage, voter ID laws ,etc. The Left never breaks ranks on the big ones while we hand wring over nuances in principle. That’s why we have been on the slow march to socialism/communism for the last 80 years. Our side is extremely stupid and hampers itself with principle while the Left has us buried up to our shoulders in liberty’s grave.
The legal definition of a conservative Justice is far different from the political definition used by most folks here.
As I said in my original post I think the Chief Justice views his role as keeping the SC out of cases that are the responsibility of the elected officials to work out.
The congress in the last 40 years have been the kids in the first grade fighting in the sandbox and the SC has become the overzealous parent trying to make everything OK.
Roberts is saying nutz to that...
