Justin Bieber Photog Beatdown Going to Prosecutors

Justin Bieber's brawl with a photog over the weekend isn't going to just disappear ... TMZ has learned the case WILL be referred to the L.A. County D.A. for possible criminal prosecution.

We're told cops have already decided to refer the case to prosecutors, even though the investigation is far from complete. They have requested to interview the Biebs, but he's in Norway now. It's pretty typical for police to refer high-profile cases to prosecutors.

TMZ broke the story ... Bieber's a suspect for allegedly committing criminal battery against a photog in Calabasas Sunday afternoon. The photog called 911 after the scuffle, but by the time cops arrived, the singer had split.

The pap was taken to a nearby hospital in an ambulance. He then filed a police report naming Bieber as the culprit.

If Bieber is charged and convicted, he'd face 6 months in jail. But the photog faces an even worse fate -- having to tell people Justin Bieber kicked his ass.

Yep, and blocking someone from entering their own vehicle could also be construed as such. There may be different levels of assault, but it was all started by Mr. Paparazzi. Now he's trying to get a few more minutes of fame.

Arguably, the pap instigated a confrontation by blocking access. It can’t be legal to deny someone access to their property.

While it might be more prudent for me to call the police in that type of situation, I'm not sure waiting around for the cops to arrive and tell the guy to scram is in Bieber's or any other celebrity's best interest.

I have lot of disdain for entertainers, but I have more disdain for the photogs. I'd give The Bieb one free punch.

I want to know why we don't any pictures of the scuffle. They would be worth some money.
I think Bieber is trying to gain some street cred..but sheesh,,,in purple shoes and Lollipop guild socks?????

I don’t think 911 would dispatch a cop if you called and said someone was blocking access to your vehicle. If police won’t respond, then you are essentially being told you have no property rights. Maybe he should have called and said he was being carjacked. The pap WAS trying to take possession of his vehicle away from him, after all.

I completely disagree with people who say celebrities have no rights to privacy in public. You can’t stalk and record regular people in public, and you shouldn’t be able to impede, impose, or photograph celebs against their wishes in public either.
