Lawyer, professor and political commentator Alan Dershowitz stopped by America Live Wednesday afternoon, where he shared his thoughts on the George Zimmerman case with host Megyn Kelly. In a nutshell: He thinks the case has gone to hell in a widely-publicized handbasket. Specifically, he believes that, if anyone should be tried in this case, it should be Special Prosecutor Angela Corey.
This affidavit, he said, submitted by the prosecutor in the Florida case is a crime. Its a crime. If she in fact knew about ABC News pictures of the bloody head of Zimmerman and failed to include that in the affidavit, this affidavit is not the truth, the whole truth and nothing but the truth.
He also took the prosecution to task for having used the passive voice a struggle ensued to describe the altercation that allegedly took place between Zimmerman and Trayvon Martin leading up to Trayvons death without adding pertinent evidence and details, such as whether Martin had been on top of Zimmerman, thus able to bash his head against the pavement as Zimmerman has claimed.
The prosecutions goal, Dershowitz explained, is to present all the details and evidence of the case in order to pursue justice, not merely to seek justice solely for one side of the case. And you dont indite based on false information, he told Kelly.
Now, one of the problems, he continued, is because theyve indited for second degree murder and theres nothing in this affidavit that suggests second degree murder, the elements of second degree murder arent here the expectations have been reduced. Theres an article today in one of the the Daily Beast saying therell be riots in the street if theres an acquittal. If there are riots, its the prosecutors fault. Because she over-charged, raised expectations. No reasonable jury is going to convict based on the evidence I know of second degree murder. So this prosecutor not only may have suborned perjury, she may be responsible if there are going to be riots here for raising expectations to unreasonable levels.
He reiterated that the case should focus on seeking justice, not necessarily on seeking justice for Trayvon, as the prosecutor has said. Any reasonable judge, he added, would throw out second degree murder.
So why might the prosecutor have raised the stakes to his level? Dershowitz has a theory:
She is a politically-elected person who was appointed to get Zimmerman. She was appointed to prevent riots. She wasnt appointed to do justice; she was appointed to calm the situation down. Thats the problem when you elect prosecutors. Were the only country in the western world that elects prosecutors. Prosecutors run for re-election based on how many people they put in jail. That doesnt produce justice.

Santorum and Bachmann should never have run at all imho, yes they both had the right to run.
LOL! I do what I can.
I have the same problem when my spell checker won’t catch when I mistakenly write “jerk” for “Obama.” They are both words, so it does not edit...or maybe it knows somethings more than I think it does...
I see that you, like me, don't use obscenities. Most of the time I don't regret it. However, it certainly does hamper my ability to refer appropriately to that, that, Imperial, arrogant, festering, Alinsky-esque mountebank.
Not to beat a dead horse, but it occurred to me, correct me if I am wrong in my assumption....Am assuming you do not buy into the junk science about global warming?
Am assuming you do not buy into the junk science of global warming, so why do you in turn buy into the junk science of shaken baby syndrome? Even the “scientist” that was credited with discovering shaken baby syndrome has taken a step back on his original assertions. The entire SBS theory has been discredited, that was what the entirety of the prosecutions case was based on.
Now you support George Zimmerman, as I do, you have probably suggested a rush to judgment on behalf of the media, prosecution same as I have.
Just thought you should not be so quick to condemn Louise Woodward who was convicted on junk science...
No offense intended!!!
I am no expert but I had not heard that shaken baby syndrome has been disproven and it is not easy to crack a human skull as happened with that child. She half confessed saying she had been rough with the child. None of that has anything to do with Zimmerman. Woodward did not get her nose broken by a baby.
You are right and everybody else is wrong, end of story right.I guess that is how you are with everybody, would not want to live with someone like that.
I had only originally given my own opinion on it, had not even responded to you, you responded to me saying you knew it all and I was basically was a moron for holding the view that I had.
A google of “ Shaken baby syndrome reconsidered” gives dozens of articles on the subject, entire numerological communities in some cases, including the actual “scientist” that came up with the theory are now openly questioning the entire theory. Hundreds of people have been freed from prison.
And like I said I only offered my opinion, and it was not originally even directed at you.
Also now I know anything you say is the Gospel truth, and no need for any further discussion, you are right and everybody else is a moron...HEAVY SARCASM
Meant to say neurological, was to fast on spell check... MY BAD
Not sure what you are getting your panties all twisted over. I said I am not an expert on the subject and said I was not aware that the science had changed on it. She was found guilty, the judge reduced her charge to manslaughter, never said she was innocent. I did google the subject and I there are some interesting articles but nothing that makes me conclude Woodward was innocent. Don’t worry about living with me I am not looking for anyone else to move into my home.
