Dershowitz: Zimmerman Affidavit ‘Irresponsible And Unethical’

Harvard University law professor Alan Dershowitz made an appearance on on MSNBC’s Hardball to discuss the Zimmerman arrest affidavit, and had some incredibly harsh language for Angela Corey concerning her actions in the George Zimmerman prosecution.

Dershowitz is a well-known Democrat with a column on the Huffington Post, but seemed stunned by how poorly written the affidavit was, going so far as to call it “irresponsible and unethical,” as well as Corey’s actions politically motivated. He also said that if the prosecution didn’t have more evidence for the case than what we’ve seen, “a good judge would throw it out.”

Here’s the interview:

Smerconish: Joining me now, Harvard law professor Alan Dershowitz. Professor, I’ve really looked forward to this conversation. You’ve seen the affidavit of probable cause, what do you make of it?

Dershowitz: It won’t suffice. Most affidavits of probable cause are very thin; this is so thin that it won’t make it past a judge on a second degree murder charge. There’s simply nothing in there that would justify second degree murder. The elements of the crime aren’t established.

Basically what’s in the affidavit is what’s in the public domain, with the exception of a few little things that were put forward by your previous commentator. But the fact that the mother identified the voice as that of her son, of course, we all knew that was going to happen. There’s nothing in there of course either about the stains on the back of Zimmerman’s shirt, the blood on the back of his head, the bloody nose, all of that.

It’s not only thin, it’s irresponsible. I think that what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation, and over-charged, way over-charged. This case will not, if the evidence is no stronger that what appears in the probable-cause affidavit, this case will result in an acquittal.

Very strongly worded statements from Dershowitz, who basically stopped just short of directly claiming Corey engaged in prosecutorial misconduct by her actions.

That’s my reaction to him too. He’s liberal, but in his Harvard University setting, he’s probably the most conservative person around.

Does the judge dismiss the charges with or without prejudice? The former, I would suspect, since “jeopardy attached”, which means that there is not a damned thing the State of Florida can do to him. Wait for Holder’s people to take a run at him on “Civil Rights” charges.

Here’s what is really going on: The establishment knows Zimmerman acted in self defense; that’s why the initial prosecutor refused to charge him with anything. To respond to the public outcry, they charged Zimmerman with second degree murder - a charge that requires intent and one they will never prove nor get a jury to convict on. If they had charged manslaughter, it is possible a jury would have convicted - but they will never convict for second degree because it requires intent. Before everyone falls in love with Dershowitz, realize that his criticism of the affidavit comes from this perspective - he knows the state has “overcharged” and therefore he knows already that Zimmerman will walk...so Dershowitz is lamenting that the fix is already in to clear Zimmerman.

Obama and Holder and Sharpton and the Black Panters have all injected themselves into this case. They are all now eligible for discovery.

They are all involved now and able to be ‘called’.

Obama and Holder cooked this up. The race pimps, and MSM didn’t really enter the equation much until Obama “adopted” Trayvon.

The LSM was all spun up on this before Obama commented. He certainly added fuel to the fire.

He seemed to have his eyes opened first with the OJ trial, then with Clinton's impeachment when he lied every day for Clinton and made himself look like a complete idiot.

After those two cases his credibility was pretty much zero and he knew it.

Perhaps she was persuaded to sacrifice her career with a flimsy charge/evidence scenario, just to get past the “we just want him to be arrested” crowds. They possibly believe this case cannot result in a conviction, and have just gone through the motions, with no real meat to the charges or anticipated outcome.

I thought about this possibility and hope it is the case. I worry about Zimmerman’s safely in the general prison population.
