CAMP PENDLETON, Calif. (AP) - A military board says a Marine who criticized President Barack Obama on his Facebook page has committed misconduct and should be dismissed.
The Marine Corps administrative board made the decision Thursday after a daylong hearing at Camp Pendleton for Sgt. Gary Stein.

Anyone aware of previous, similar and actual cases that were prosecuted or not prosecuted? Can’t believe this is the first time this has come up.
Like it or not (I don’t), the “O” is the current commander in chief. The UCMJ is very clear about disrespect to a superior officer. The Sergeant screwed up.
I would be interested in seeing just what misconduct was charged. Art. 86 doesn’t apply to enlisted, and those prohibitions that apply to everyone, (actively participating in a campaign etc., don’t seem to have been violated)
On the surface, it seems that criticism of Obama has been criminalized.
Unfortunately it probably will be a democracy before long with the continued social experimentations that are ongoing like the repeal of DADT etc.
You gotta be a member of a "Protected Class", ie, faggot, dyke, black, Muslim, etc., as a heterosexual white Christian male with guts is TABOO in today's "Justice System", AND, in the Military.
As much as I abhor Obama and all he stands for, the idea of the military staging a coup, bloodless or otherwise is the antithesis of 200 + years of American history and what it means to be a Constitutional Republic and what separates us from being a Banana Republic where one political party or another gains control of the military and enforces a coup, in some countries this happens every few years. Is this what you are really advocating for?
Did my own research:

Are the MSM, the ACLU and the Military Law Task Force of the National Lawyers Guild supporting the Marine’s right to free speech?
Naw, no evidence of it found. Soon the Obamites will require anyone who criticizes the aO-Bama to wear a “White Star of America.”
Stein said his statement about Obama was part of an online debate about NATO allowing U.S. troops to be tried for the Quran burnings in Afghanistan. In that context, he said, he was stating that he would not follow orders from the president if it involved detaining U.S. citizens, disarming them or doing anything else that he believes would violate their constitutional rights.
Sounds like he is stating that he would follow his oath, and defend the Constitution and only follow legal orders. In that respect he is following the UCMJ.
All hail the usurper in chief, the most successful communist traitor mole in history!
Unfortunately the Officer Corps is more political (or if you please CHICKEN SH!T) than they need to be
Amen.!!!!!!
It's more than time we fought back. We conservatives shouldn't care if libs like us. We haven't been aggressive enough because we want to be liked. That's why our debt is where it is at. We should make it our mission in life to get under their skin and maybe plant some seeds of common sense in the minds of the moderates.
Write a very public post on a very public forum that you will refuse orders from your CEO, and let me know how that free speech works out for you.
All freedom of speech means is that you can’t be tossed in prison for speaking your mind. That’s it. It’s not a guarantee of “consequences-free” speech.
What he said was dumb. I think an OTH discharge is ridiculous—at worst it should be a General discharge, but the reality is he screwed up, words mean things (at least for us, not for POTUS, apparently) and he’s going to pay a price.
Do you give up your “freedom of speech”?, yes you do. More accurately put, you give up your “freedom”. It isn't “taken” from you, you give it up, willingly. It's a necessary part of the contract.
Without discipline, all the technology, weapons, strategies,
would be worthless. While you are under the president's command, keep your mouth shut OR be prepared to suffer the consequences.

Quit making an ass of yourself in front of the entire membership and buy a clue.
Soldiers/Sailors/Marines don't get to ignore the UCMJ whenever any-ol-somebody becomes a s***house lawyer and declares someone or something in their chain of command "unconstitutional."
Such a proposition is absolutely absurd. You're absolutely absurd.
Oh, let’s see...
O’bummer, his admin, EPA czarina, Moochelle, tax-payer paid vaycays or...
Marine who puts his life on the line and has an opinion...
no choice there.
Personally, I think the good sarge deserves a medal.
He called it as he saw it, unlike many in those same ranks who are afraid to speak out. The UCMJ puts one in a BIG corner when we speak of our “rights”.

“...dismissed after ignoring warnings from his superiors...”
Key point here.
