Ginzberg, Sotomayor, Breyer and Kagan would never vote against it. Kagan or Sotomayor in a losing effort may try to establish their bona fides. Exactly as Congressmen do on a losing bill, by agreeing with their leadership to vote against their party to protect themselves from their constituents.
