The Justice Department should look into the Stand Your Ground laws that kept Florida police from arresting the man who shot and killed 17-year-old Trayvon Martin, New Yorks senior senator said Sunday.
Sen. Charles Schumer (D-NY) said he wrote the Justice Department asking them to expand their review of Martins death to include the impact of Floridas and other states Stand Your Ground Laws.
Stand Your Ground laws is a whole new concept, Schumer told CBS Face the Nation. Some people call it shoot first, ask questions later, he said.
The laws generally grant immunity to anyone who uses deadly force, inside or outside of his home, if the shooter can reasonably claim he was defending himself.
The laws all passed very, very quickly and I think the states who passed them, if they find the real facts, may decide to repeal them, Schumer said, noting a survey of 13 cases by the Florida Sun-Sentinel that found 12 of the victims had not been armed.
Florida was the first of 21 states to pass such laws since 2005. The Sunshine States version allows police on the scene to decide whether they believe a shooters claims of self-defense.
In Trayvon Martins case, police have said they did the right thing by not charging 28-year-old George Zimmerman, a member of a citizens' watch, with the shooting.
Court-watchers say in other cases, cops make an arrest and then let the courts figure out if the use of deadly force was legally justified.
Schumer said he wants Justice officials to see whether these new laws actually increase violence rather than decrease violence, and whether they actually prevent law enforcement from prosecuting cases where real crime has been committed.
Zimmerman told police Martin attacked him after he had given up chasing the boy and he was returning to his truck. He had a bloody nose and blood on the back of his head, according to police.
Martin's family doubt Zimmerman's story and argue if the shooter was black there is no doubt he would have been arrested.

OK, Senator, I guess I can see where you're coming from with that. For the sake of comparison, can you tell us which laws that LIMIT people's rights you've called for a review of? Can you explain in detail, what outcomes justify review of THOSE laws, the ones that DISempower those who pay your salary? Or is it just the laws that return some small fraction of the power taken from them and given to functionaries like you, that need reviewing?

Well, sure. SOME people call you a sentient hominid. You can always find someone with almost any opinion you care to cite; you can't use THAT as a gauge of reality.
1. anti-gun folks will want to get rid of the stand your ground law.
They wanted that anyway. Maximum deprivation of rights is always their goal, regardless of the current score.
2. pro-gun folks (of which I include myself), in defending stand your ground, will feel the need to defend Zimmerman. I think that may be a mistake. I think Zimmerman was actually advancing on the kid, and even the 911 dispatcher told him not to. I just hope that Florida law enforcement takes a closer look at Zimmermans claims.
I don't feel any need to defend him. The only "facts" I have access to are laundered and agenda driven by one side or the other. I'm fully mentally prepared for Zimmerman to turn out to be an asshole (I'm actually sort of leaning that way). Assholes have guns. Even some liberals have them.

Yesterday’s NY Post published previous 911 calls Zimmerman had made about other kids walking down the street.
Unfortunately the guy in charge of the “Justice” Department is a black racist who was picked by and works for, an even bigger Black Racist.

Senators like Chuck are the #1 reason WHY the People should be at all times armed.

Schumer is the symptom. It's the majority of the voters who elected him who are the disease. New Yorkers not only want to cower in fear and lick the jackboots on their necks, they want everyone else in the country to do so too.

The law only prevents an arrest if the police have no reason/evidence to think it was not self defense. So I guess Chuckles would have the police arrest anyone who defends themself, regardless of probable cause to believe they committed a crime. Well he’s against the second amendment, so why not the fourth and fifth as well.
The police did take him into custody. Handcuffs and everything. It's in the video ABC released of Zimmerman arriving at the police station, and a short chuck of time when he was inside it.

No he did not, he told him "you don't need to do that". Where "that" was follow the kid. Hardly a command not to do so.

The case is being sent to a grand jury.
