CBS ^ | 3/16/2012

The leader of a self-described black militia group says members will go to Sanford next week to attempt a citizen's arrest on George Zimmerman, a neighborhood watch leader who admitted to fatally shooting unarmed black teen Trayvon Martin.

Najee Muhammad, a member of the New Black Liberation Militia, announced Thursday that members of the group plan to take the 28-year-old Zimmerman to federal authorities since local police haven't acted.

Obama worshipping media will fan the flames of this fire. Race-baiting will continue to be the rule of the day by the press, the liberals, and the Democrats.

I won't be surprised if we see Al Sharpton, Eric Holder, and the Messiah himself come down to Florida. With a fawning national and Florida media following, parrotting and amplifying every word they say.

Pretend, for just a second, that a WHITE MILITIA GROUP announced it was going to go after a person who supposedly shot a young white youth. How fast do you think the national media and the Obama "Justice" Department would be to descend upon that group?

These guys are itching for a gun fight - which is what they would get if they tried this on me or mine...

latino backlash

Yep, would not be the first time. It has happened before along the lines of "you did what to my sister? (or mother). Not a good thing, Black Militia would probably loose that one.

A spokeswoman for the Southern Poverty Law Center, a civil rights group that monitors hate groups, said her organization didn't have any information on The New Black Liberation Militia.

Is anyone surprised by this? Really?

They obviously don't understand the limitations on making a citizen's arrest...

PREDICTION (IMO): This will get the NBLM very bloody PDQ...
...and justifiably so-- if they attempt to use force in the "arrest".

Popcorn anyone...??

So they're going on record telling the dude that he's about to be physically assaulted and kidnapped by a mob of radical militia.

They just handed him the perfect self-defense argument if he were to shoot a few dozen of them.

If there’s any justice left in the system, the federal authorities will be ready to make an arrest when Zimmerman is brought in. An arrest for kidnapping as they let Zimmerman go.

I don’t know the details, or if Zimmerman should be arrested. But this plan is not a citizens’ arrest and should treated for what it is if they attempt it.

Arrest requires:

1. Observation of a crime

2. A warrant issued by a judicial authority.

If you do not have those, you are kidnapping. Given that kidnapping is a state crime too, I think this guy better be really careful.

Good point...

Each state, with the exception of North Carolina, permits citizen arrests if the commission of a felony is witnessed by the arresting citizen, or when a citizen is asked to assist in the apprehension of a suspect by police. The application of state laws varies widely with respect to misdemeanors, breaches of the peace, and felonies not witnessed by the arresting party. For example, Arizona law allows a citizen's arrest if the arrestor has personally witnessed the offense occurring.[35]

American citizens do not carry the authority or enjoy the legal protections held by police officers, and are held to the principle of strict liability before the courts of civil- and criminal law including, but not limited to, any infringement of another's rights.[36] Nonetheless many citizens' arrests are popular news stories.[37]

Though North Carolina General Statutes have no provision for citizens' arrests, detention by private persons is permitted and applies to both private citizens and police officers outside their jurisdiction.[38] Detention is permitted where probable cause exists that one has committed a felony, breach of peace, physical injury to another person, or theft or destruction of property.[39] Detention is different from an arrest in that in a detention the detainee may not be transported without consent.

Source

So, having not witnessed the 'crime'; we have a group of "Black Miltia" that have taken upon themselves the right to apprehend, contain and transport an individual - without either authority, legal protection, nor sanction of the local police. This seems like it could easily be construed as kidnapping with intent to inflict grave bodily injury; and could wind up very, very badly for all parties involved.

The Sanford police department has handled this situation very poorly.

A young teenager was shot dead by a lone, armed civilian under the cover of being the Neighborhood Watch designee -AKA vigilante.

Zimmerman’s claim of self-defense is self-serving. He should have been taken into custody by LE and questioned, examined for forensic evidence etc., All law abiding citizens should be outraged by this senseless killing.

I don’t know how it works in America but in Britain you don’t need a warrant to effect a citizen’s arrest. You do need to witness the offence however, and it must be an indictable one (roughly equivalent to a felony, rather than a misdemeanor). You also need to know what you are doing, because if you make an illegal arrest, your in a whole heap of s**t with the cops, who generally aren’t well disposed to people muscling in to what they see as their professional remit.

All things considered, I doubt these fumducks would be acting within the law by trying to arrest someone for something that they did not witness for themselves. If they followed through with their threats, they are probably going to end up injured, dead or in jail...

These guys are itching for a gun fight -

So true, and not very smart, considering that the target of this would be "citizen's arrest" is already shown to be more than ready to defend himself against criminal activity.

The real question is, who is going to pretend to be more shocked when another person ends up dead in this incident.
