Employers are facing more uncertainty in the wake of a letter from the Equal Employment Opportunity Commission warning them that requiring a high school diploma from a job applicant might violate the Americans with Disabilities Act.
The development also has some wondering if the agencys advice will result in an educational backlash by creating less of an incentive for some high-school students to graduate.
The informal discussion letter from the EEOC said an employers requirement of a high school diploma, long a standard criteria for screening potential employees, must be job-related for the position in question and consistent with business necessity. The letter was posted on the commissions website on Dec. 2.
Employers could run afoul of the ADA if their requirement of a high school diploma screens out an individual who is unable to graduate because of a learning disability that meets the ADAs definition of disability, the EEOC explained.

How many welfare mothers dope their kids up with cold syrup and get them labled ADD so they can get another $700 per month per ‘disabled’ child.
Now they cannot be held accountable for their parent’s actions to make money off of them as children.

It took me a couple minutes to make the connection, but you're right. The ADA is an abominable piece of legislation that its sponsors admitted would be written by judges and bureaucrats. But Bush was so "compassionate" he signed it anyway.

Back in ‘95 a friend showed me a job announcent for a federal position in the DC area. This announcement was for an Operations Research Analyst. The basic qualification was a college degree in engineering, mathematics, physics or some other degree program requiring at least 12 semester hours of math including calculus. The announcement was only open for those with mental disabilities.
Yes, indeed! That is the message employers get.

While in a supervisory position, I got the third degree from HR for expecting people to show up for work on time unless they had a valid reason, and expecting people to show up for work sober.
Expecting a work ethic is now hateful, hurtful, mean spirited, narrow minded, and judgemental. Not to mention racist, sexist, and homophobic as well.
EEOC has been an abomination from the start but it’s long past time to close that racist looney bin down.
Why would, or should, a laborer need a high school diploma? We aren’t talking rocket science. We are talking pic and shovel.
And how many Civil Service jobs can you get in this country without a highschool diploma or GED? It’s a major requirement to even take a test. Another example of the government ordering others to “do as I say, not as I do.”
Sooooo, I guess this means we no longer need to fund public education? NO diplomas, NO schools, NO teachers union. Hey this could be a good thing, right?
