Employers are facing more uncertainty in the wake of a letter from the Equal Employment Opportunity Commission warning them that requiring a high school diploma from a job applicant might violate the Americans with Disabilities Act.
The development also has some wondering if the agencys advice will result in an educational backlash by creating less of an incentive for some high-school students to graduate.
The informal discussion letter from the EEOC said an employers requirement of a high school diploma, long a standard criteria for screening potential employees, must be job-related for the position in question and consistent with business necessity. The letter was posted on the commissions website on Dec. 2.
Employers could run afoul of the ADA if their requirement of a high school diploma screens out an individual who is unable to graduate because of a learning disability that meets the ADAs definition of disability, the EEOC explained.

Personally I like this. We have to insist that this be carried all the way.
No longer can the FBI insist on College Graduates, and No longer can anyone in the Government be turned down for a promotion because thay do not have a college education.
If a High school Graduation cannot be required, then we can no longer require a college education.I know of many people in the Government who do the work while a collge grad gets paid for the job. I love this if we can just force it to it’s climax of not having a college education be an impediment to Government promotions.

And some people are still wondering why America has gone to hell in a handbasket. Having said that, a high school diploma from one of our public schools really doesn’t say much about one’s abilities, knowledge and intelligence. About all it shows is that the owner probably attended the prom and bothered to show up for graduation ceremony.

Requiring a college degree in chemistry for a job at a pharmaceutical lab is also a civil rights violation. If a retarded alcoholic Democrat wants a job at your biotech firm, you better forget all that silly “qualifications” crap and just hire her!

This is interesting. Because the Supreme Court has decided that only diplomas can be used to determine ability to perform in a job, that companies cannot hire based on tests, which is just the opposite of this decision, the government is, in effect saying:
“You must hire the handicapped and minorities who are incapable of doing the job they are hired for, and you cannot determine that they are incapable before hiring them, nor fire them based on non-performance.”
How about saying enough to this nonsense?
Instead, we go back to a system where companies can hire who they want to hire, fire who they want to fire, and police can use profiling to determine the likelihood of violating the law.
So a poor black man who dropped out of 5th grade, has an extensive criminal record, and was crippled in a gang shooting by a rival is s.o.l. trying to become a Microsoft Certified Engineer, even though he wants a high paying job doing as little as possible.
How unfair.
