It was decided by a panel of judges

I am not sure that's accurate. What I heard Judge Napalitano explain was that 6 were regular jurists and two were judges...and the judges get 2 votes each.

Also the panel is not prohibited from the discussing each days testimony and evidence prior to deliberations....they were able to freely discuss it among themselves each evening.

Actually only the head judge got 2 votes the other judge only got 1 vote as did each of the 6 regular jurists.
