All she needs to do is show malice. Her husband never was a big name public official, and neither were her kids.

I'm pretty sure somebody in the family will end up owning a really huge settlement ~

It’s practically impossible for a public figure to win a libel case without a signed confession. The e-mails might just make this an exception.

Sure she would. The book is pure speculation and unfounded rumor, published with malice aforethought, in an attempt to injure the Palins.

Palin's lawyers have the goods on this guy, and the publisher. The publisher has no documentation to back up the tawdry slanders in the book, and McGinniss even wrote an email to a friend admitting that, prior to publication.

I think any court would throw the book at Crown Publishing and Joe McGinniss.

She’s threatening to sue and that’s what i believe is her intent - to threat which will make RH jump....pull the book off the shelves and prove that its a lie by their actions.

She is running for President

In most cases I’d agree with you. She’s a public figure and winning a libel case as a public figure is very difficult. But the e-mails that essentially acknowledge a reckless disregard for the truth are pretty damning.

I think she can win the liability issue on summary judgment, leaving only the damages to be determined.

Being a public figure means that she has to establish malicious intent and disregard for the truth, this book is so far beyond the pale, it should be quite easy to established.

One thing is certain, if this case were to reach the USSC and CJ Rhenquist was still alive, it would be a 9-0 decision and Rhenquist would assgn himself to write the opinion. He ws death on slander and defamation. He wrote most, if not all, opinions in defamation cases while he was the CJ.
