Truth is Perry is toast and the base is looking for a true conservative to take his place now that they see who he is and what his record has been. Until I see Rasmussen, or even Gallup come out with their new numbers, it remains Perry v Romney.
That's fine as far as it goes. That's pretty much what is in play right now and I think it's quite successful. But what is his reaction in the case of the diehard gun ban holdout Illinois? Well, it's states rights. But it's not. It violates the due process and equal protection clauses of the 14th Amendment. Again, he doesn't have to meddle in the states affairs BUT he does have to stop them from trampling on the US Constitution!

I like both Michele Bachman and Herman Cain but neither one in my opinion will be president..Heaven help us if Mitt Romney becomes president..
Dummy, I was asking for a source for your claim of Herman Cain’s position *being pro gun ban) not a legal source. Now, do you have a source for your claim about CAIN?
IDK if you teach US Gov in High School, I taught History at a University. Also I’m married to an attorney. So, your ‘qualifications’ don’t give you any credence. I know the legal sources, I want a source for your claim of Cain’s beliefs.

It’s going to be interesting to see all of the polls coming in this week. I think you might see a small rise in Cain, but in general, the establishment candidates will still be significantly on top. It may be disheartening, but I think you will continue to see Perry vs. Romney all day, all night, and how both are crap...That is what the establishment/media wants...
Doesn't have to meddle? Isn't allowed to meddle would be more correct. The 14th Amendment is an odd duck in that it departs from the pattern in the Bill of Rights restricting the Federal government only. The "privileges or immunities" of citizens are now protected from State violation; there is good evidence to suggest that Congress had the right to bear arms specifically in mind.
However, does he have to stop States from committing violations? He can't write a law against it: he's not Congress. Even then, Congress can't pass bills commanding the States to do anything. He can't have the Justice Department sue: they aren't a party that has been wronged.
"Let each state pass a concealed weapon bill." That's about as far as he, as President, can Constitutionally go. It's a stretch to claim that Cain is against 2nd Amendment rights simply because he is mindful of the constraints of federalism.

I think Attorney General at the direction of the POTUS could have the Justice Dept file a brief to the USSC to ask them to intervene in the event of a state level breach of the US Constitution. I'm reaching back here 25 years to my own time in law school, so bear with me if I mess it up, but perhaps a writ of mandamus? Compelling the state to follow the US Constitution? Not certain here, but pretty certain there are such mechanisms in place. Sorry for calling you and the wife fools. I don't react well to ad hominem attacks....

That's a good reason to seriously support the eventual candidate. Now is the time to decide who that candidate should be. Cain's grasp of federalism gets my support in the primary election; I don't think he's shaky on the 2nd Amendment (or gay marriage, or abortion, or border security, for that matter).

BTW, the quotes you gave state that he believes it to be a states decision (which is correct). It does NOT however state what you claim that he is in favor of gun banning laws. CCW laws are also state control legislation.
