The hallmark legislation of the Obama administration, Obamacare, took another body blow when the 11th Circuit Court ruled Friday that the individual mandate requiring adult persons in the U.S. to purchase health insurance is unconstitutional.
Where have we heard that argument before?
While the court didnt go so far as to declare the entire act void, it effectively scrapped the legislation by denying it the source of its funding. The administration is expected to appeal the ruling, but a final decision will likely come in the U.S. Supreme Court.
A coalition of 26 states, kind of an ad-hoc death panel for Obamacare, is suing the federal government to stop implementation of Obamacare, arguing that key provisions of the act are illegal.
Stopping funding for a federal project favored by the Democrats is like putting a plastic bag over the head of the lobby that favors it. Itll cut off the fuel and thereby kill it.
A key argument by the states was that the power to require Americans to purchase a product gives the government unlimited powers to regulate all aspects of someones life and is thus unconstitutional.
The 11th Circuit Court seems to agree by a 2-1 margin: The governments position amounts to an argument that the mere fact of an individuals existence substantially affects interstate commerce, and therefore Congress may regulate them at every point of their life. [My emphasis]
In short, its the same old argument liberals always make that the mere ability to pass legislation is more than enough reason to do it, 'cuz "Hey, let's see what's in it.".
Forbes quotes the crux of the argument from the 11th Circuits Death Panel thusly: The federal governments assertion of power, under the Commerce Clause, to issue an economic mandate for Americans to purchase insurance from a private company for the entire duration of their lives is unprecedented, lacks cognizable limits, and imperils our federalist structure.
While politically the passage of Obamacare was the biggest legislative accomplishment of the Obama administration, more and more Americans are growing uneasy about the wisdom of the legislation as they find out whats in it.
In June, a CNN poll showed that more Americans opposed Obamacare than supported it by a landslide margin of 17 percent. A Rasmussen poll in August showed a margin against by 14 points. And it looks like opposition is coming from both Democrats and Republicans.
The Washington Post quotes Ilya Shapiro of the Cato Institute as saying One of the striking things about todays ruling is that, for the first time in one of these cases, a Democrat-appointed judge, Frank Hull, has ruled against the government, although Shapiro warns that the fight is far from over.
Supporters of limited constitutional government need to temper their celebrations just as they wisely tempered their sorrows after the last ruling because we must all now realize that this will not end until the Supreme Court rules, Shapiro concluded.
Progressives ballyhooed the legislation as healthcare reform that would help lower costs and increase coverage. But its becoming increasingly clear that while it may increase coverage, costs will skyrocket.
As Townhalls political editor Guy Benson noted in June, 1 of 3 employers will probably cancel employee coverage by 2014 because of Obamacare.
A survey by Mercer finds that 55 percent of employers think that their costs will go up as a result of Obamacare, while premiums already continue to rise.
Rising health care costs are putting a huge financial burden on employers across the country, says Robert Zirchelbach, a spokesman for Americas Health Insurance Plans, which represents insurers who provide health benefits to some 200 million Americans according to the San Antonio Business Journal. Rather than help control the rising cost of medical care, the new health care reform law instead imposes billions of dollars in new taxes and benefit mandates and will significantly increase the cost of coverage for employers and their employees.
Its just another example of the Obama administration passing laws that dont even attempt to solve actual problems faced by the American people, but rather try to take advantage of problems faced by the American people by passing legislation that increases the reach of the federal government regardless of the consequences to personal liberty.
Hopefully Obamacare will meet with more death panels in the future.

That second to last paragraph is an excellent summation. Wish I could figure a way to put that on a bumper sticker.
I can never understand the “stops short of throwing out the entire law”.. I thought Congress failed to insert the severability clause, so any part ruled unconstitutional meant the entire act was room temperature.
Don’t be surprised if Obama himself says “No Obamacare” NOW as part of his election campaign. I know it sounds crazy...but I think it’s his best card.

Tell me please, anybody, can you remember the last time, other than military action, the government did anything that was really good for the people of the United States.
1. Lowering taxes, that is our money to begin with. This has been done but it is just what should be.
2. Some breakthrough trade policy that facilitates the dominance of American business, jobs and prosperity?
3. Some policy that facilitates a technology that gives the United States a proprietary advantage over the rest of the world?
4. Some sweeping change in the laws that put less or no money in the pockets of lawyers and big business and more in the pockets of most? National Tort reform? Balanced Budget?, repeal of Base Line Budgeting?, Throw away the tax code?, replace the tax code with a Flat Tax?, Streamline the armed forces but make them stronger in the process?, Sweep the Federal Register of duplicate, outdated, unnecessary and downright burdensome and foolish rules? Allow insurance to be sold across state lines and introduce competition to both insurance and health care?
Anything? Anything at all? Anybody?
How can an appeals judge even decide in favor of this law. Do tney need a refresher in the constitution for dimmies?

DEFUND domestic totalitarian collectives. Impeach, convict, imprison totalitarian legislators.
But how is this legal plunder to be identified? Quite simply. See if the law takes from some persons what belongs to them, and gives it to other persons to whom it does not belong. See if the law benefits one citizen at the expense of another by doing what the citizen himself cannot do without committing a crime.
Then abolish this law without delay, for it is not only an evil itself, but also it is a fertile source for further evils because it invites reprisals. If such a law which may be an isolated case is not abolished immediately, it will spread, multiply, and develop into a system.

I hope you’re right but doubt that the former “professor” of constitutional law will throw in the towel on his signature legislation. That would be too politically devastating for him. More likely that the Dems will contrive a slick work around that involves changes in agency regulations in the dead of night.

In my heart, I know there are many people who need help and my heart goes out to them...and if I can help, fine...but I really don't want to pay for every Tom, Dick and Mary.
While the legal system grinds along slowly spending on Obamacare continues apace. In the meantime, hundreds of millions of dollars are being needlessly wasted in implementing the provisions of the legislation, which it now appears will not survive in its current form if at all. Given the dire financial condition of the country, the USSC should find a way to expedite the decision.
