Yes, but regardless of either Court’s decision it will be appealed to the Supreme Court of the U.S.
I am hopeful that the Supremes will uphold Prop 8. To declare a constitutional amendment unconstitutional is pretty ridiculous.

And to uphold a former judge’s decision that was a blatant disregard of the concept of “conflict of interest” in the first place, when that same judge had a homo relationship and should have excused himself.
This state already last week approved free tuition to illegals and now this...
What about a judge’s Marx-given right to over-rule the results of a free and fair election and write her own law?

Under the state constitution, at least 20 senators had to be present to pass the measure because it included fiscal elements, and the Republicans hold just 19 seats.

Today I was listening to Jeff Wagner on radio 620. He was having a good time slamming teachers and the WEAC in particular. He was proclaiming that they have been rendered impotent and that the battle for GOP’s “progressive” budget was almost done. Better yet, he was proclaiming that the resistance has lost their will to fight and seem to be giving in. As proof, he talked about how the highly advertised “Walkerville” was a joke with a mere 30 tents per night camped out on the square. He commented that last weekend’s teacher lead march garnered all of about 25 people.He also mentioned
that a “giant rally” today on the Wis. Manufacturers & Commerce Assoc. only attracted a measley 100.
He said the liberal cause had all but petered out and they were laying down and giving up and that victory would be theirs by the end of the week. Are we going to let them think we no longer care? We can no longer sit back and let the next guy fight our battles for us. We can no longer sit back and complain if we aren’t willing to do something about it. It’s time for everyone who believes in this cause to stand up and be counted in Madison tomorrow.

With the news that legislative leaders are calling an “extraordinary session” to limit the democratic process and ram through Governor Walker’s dangerous and hurtful budget, Mary Bell has issued a call to action for WEAC members to come to Madison on Tuesday.
Join us as the people of Wisconsin rally against Walker and Republican legislators who, through a political maneuver, are suspending normal rules and will allow Republicans to take up unforeseen issues, limit debate, limit amendments and limit democracy - making it possible to ram the budget through quickly.
We cannot allow this to happen.
Recruit your families and friends, make your signs and join Wisconsin’s nurses, firefighters, public employees and concerned Wisconsinites to send a message to legislators that Wisconsinites are watching - and we’re not going to allow these extreme actions to go unnoticed.

This should be a wake-up call to conservatives that we are just one or two elections away from a socialist court in Wisconsin. they are reading the same constitution and coming up with different interpretations.
The same thing is going on all over the country.
True this was a narrow escape, but still a victory! It would have been a complete turn of events if they had been able to get Judge Prosser off the Supreme Court.
