OKLAHOMA CITY - An emotional jury decided Thursday that pharmacist Jerome Jay Ersland is guilty of first-degree murder for fatally shooting a masked robber two years ago in an Oklahoma City drugstore.

Jurors recommended life in prison as punishment.

Two co-workers at Reliable Discount Pharmacy told jurors that Ersland was a hero who saved their lives on May 19, 2009.

If he came after me, to kill me, yes; without hesitation.

Generally we are not faced with our nephews threatening us, and in that event we are acquainted with this person so in a better position to ascertain whether they are a threat. In THIS case however, no one knew the attackers and were NOT in a position to ascertain whether they were a true ongoing threat. Only course is to stop the threat and that means death to the perpetrator. Sorry.... I know... sounds harsh... but in the heat of a situation... this is the only course. So we come back to the fate of the robber was chosen by himself.

Defending a murderer is wrong, why do you do it?

If he’s coming after you, he’s actively seeking to harm you. You can kill him.

However, the only thing the law allows you to do, if he’s down and out, is to get away.

How are you to know someone is truly incapacitated? That requires that a civilian, under attack have special ability to determine you are no longer a threat. Also requires that same civilian, who may be freaking completely out of their mind, act with the professionalism of law enforcement... ridiculous.

The only murderers during this incident were the criminals who were robbing the pharmacy. Others involved were defending themselves.

I have family who live in the LA basin. I know what you mean.

I lived in Southern California during the Watts riots. My family was out past Whittier, so we weren’t directly affected. But the lady who cleaned our house live in Watts. My mom invited her and her two daughters to stay with us during the riots, but her mom lived there, too, and she didn’t want to leave her invalid mother alone.

Maybe men don’t understand what women face. If our attacker isn’t put down permanently, they can get up and come after us. We rarely get a second chance. It isn’t worth risking our lives to be half-way about anything like self-defense.

It’s not harsh to take the life of somebody, who is actively seeking to harm you.

Howver, there is no justification for doing so, if he’s no longer able to do so. It would be about as justifiable as going to his hospital room, while he’s in a coma, and putting the gun to his head and pulling the trigger.

You might want to do so, but there’s no justification for it.

If he’s not moving, he’s not a threat. How subtle can that be?

As I said, you can kill him if he moves, but he must move. If he doesn’t move, you’re not likely going to win with either the judge or the jury.

Not just women ... some men are not as strong and need to defend in the same way. I am sorry to all who don’t agree, but kill the bastard is my mantra if someone is committing a crime against me, my family, my friends, my business or just randomly on the street. I’m not going to take his pulse after I bash in his head to see if I should bash him/her again! What the HECK is going on here on FR!!!! Never thought I would see this kind of defense for a piece of scum like I have seen on this thread, for God’s Sake!!!!

How do you ascertain that? You are living in LA LA LAND. Kill the SOB if he/she is attacking you in any way. Or face the fact they will kill you.

That requires that a civilian, under attack have special ability to determine you are no longer a threat. You remember that your hero, is a war hero don't you?

Also, nobody is expecting you to take a pulse, or pupil dilation.

Do you really need to be an expert to decide if he’s moving or not, if he sits up?

Listen, Jonty: my sister is certified crazy, as in batshit crazy! She is so crazy, she’s on Social Security at age 55 for a ‘personality disorder’.

This woman has threatened, repeatedly, to kill me over the past 15 years.

I never allow us to be alone. NEVER!

(Her son, my aforementioned nephew, of whom I had custody, is a good guy. I only used him as an example; he has perfect morals and is a caring human being. After all, I reared him that way!)

If my sister came after you with a weapon, would you not finish off the job, knowing she is crazy and will come back later to finish you off?

I’m not joking about this situation. Until you’ve lived it, day in and day out, you don’t know what it is like!
