27 of 50 States Now Challenging Constitutionality of Obamacare in Court

More than half of the states—27 out of 50—are now challenging the constitutionality of Obamacare in federal court.

Six additional states--Iowa, Kansas, Maine, Ohio, Wisconsin and Wyoming--petitioned in federal court on Tuesday to join Florida’s law suit challenging the constitutionality of the health care law President Barack Obama signed last March. Nineteen states had previously joined with Florida in this suit, making the total number of states that are now a party to the suit 26.

Virginia, which has filed its own lawsuit against Obamacare, is the 27th state challenging the constitutionality of the health-care law in federal court. (A complete list of all 27 states appears at the bottom of this story.)

Florida’s suit challenges the constitutionality of Obamacare on two grounds, arguing that the law’s mandate that individuals must buy health insurance exceeds the legitimate power granted to the federal government to regulate interstate commerce under the Commerce Clause of the Constitution and also that the mandates the law imposes on state governments to expand their Medicaid programs violates the 10th Amendment, which limits the federal government to the powers delegated to it by the Constitution.

Nah, to be more than half the states you would need 29 per “Fearless Reader” and his “57 states”.

Those 27 states will have 284 Electoral Votes in 2012.

I’m surprised that Oklahoma, Tennessee and North Carolina haven’t joined in.

Yes, But Obama is only in his third year of a ten year presidency. There's a long way to go.

(Indonesia has 10 year presidential terms, so when Obama said he might be president for ten years, it makes sense.)

CJ Roberts doesn't want anymore history making 5-4s if he can avoid them (plus Obama has lately been giving plenty of booze drugs and hookers to swing vote Kennedy).
SCOTUS is gonna wait and see how this one plays out between the Hill and Obama first.

BTW, just to make it clear to all fascist Northeast states, Joshua Chamberlain left the Northeast 100 years ago, and he ain’t coming back.

Solid red state Tennessee does not seem to be a party to the suit yet. We will see if we can get our AG to get moving.

Need 38 states for a Constitutional Convention. A lot could be accomplished. Of course there is also the chance that 3/4 of the states could ratify something awful too.

Oh, wait, never mind.

Oh, and I already pay $400 a year on my county tax bill for medicaid, in addition to the part of my withholding taxes taken from my paycheck for other medical programs. All this is before I pay even one cent for my families’ own medical costs and insurance. We can not afford anymore healthcare related fees, taxes, mandates, whatever you want to call them!
