Judge's final actions key to federal charge for his murder (Dupnik Screw-Up Could Help Suspect!)
Politico ^ | 1/11/11 | Politico

The criminal complaint federal prosecutors filed Sunday against the alleged shooter, Jared Loughner, goes to some lengths to demonstrate that Roll didn't show up at the Giffords event just to say hello to the congresswoman, or on some whim after attending mass, as reports Saturday suggested. That storyline was fueled by Pima County Sheriff Clarence Dupnik, who said "because [Roll] knows Gabrielle very well, [he] came around the corner to say hi. Unfortunately he was in the wrong place at the wrong time."

By contrast, FBI agent Tony Taylor argues that Roll was at the event to talk to Giffords about ongoing problems related to a surge in the federal judicial caseload in Arizona--a problem which the judge has attributed to a boost in the number of federal agents sent to the area to address immigration and border-related crime.

Judge’s final actions key to federal charge for his murder

The actions and motivations of U.S. District Court Judge John Roll just before he was shot dead at Rep. Gabrielle Giffords’s campaign event in Tucson on Saturday are important for the public narrative about the tragedy, but they’re also vital to the federal criminal charge for his murder.

The criminal complaint federal prosecutors filed Sunday against the alleged shooter, Jared Loughner, goes to some lengths to demonstrate that Roll didn’t show up at the Giffords event just to say hello to the congresswoman, or on some whim after attending mass, as reports Saturday suggested. That storyline was fueled by Pima County Sheriff Clarence Dupnik, who said “because [Roll] knows Gabrielle very well, [he] came around the corner to say hi. Unfortunately he was in the wrong place at the wrong time.”

By contrast, FBI agent Tony Taylor argues that Roll was at the event to talk to Giffords about ongoing problems related to a surge in the federal judicial caseload in Arizona—a problem which the judge has attributed to a boost in the number of federal agents sent to the area to address immigration and border-related crime.

Under federal law, the murder or attempted murder of a U.S. official, such as a judge, is only considered a federal crime if committed “while such officer or employee is engaged in or on account of the performance of official duties.” In other words, if Roll simply stopped by the event to greet Giffords, who he’s said to have been friendly with, or due to idle curiosity about what was happening there, his killing probably wouldn’t be a federal offense.

Dipstik needs to shut up before he screws this whole case up. He needs to go back to his office and resume his nap. He should leave this stuff to the professionals.

The “good sheriff” is a despicable threat to this investigation and to teh peace of this country. Did you see how quickly the FBI acted to take this case from him, and just as he was about to march Loughner out in public?

I’m furious that this irresponsible sheriff is being treated like grandpa law enforcement when he is an ugly partisan bufoon.

And I’m sure he would say my paragraph above is responsible for the next mnass murder. He is a disgrace.

Pima County Sheriff Clarence Dupnik is an embarrassment to legitimate law enforcement. He must be canned ASAP

He looks like a Dipstik. Somebody needs to tell him to button it and disappear.

Politico exposes this? Amazing. They have a mouthpiece for the democrat party line doing a fine job of slandering citizens rights to a regress of grievances, Palin, Tea Party, etc., and Politico puts the dunce hat on him.

I smell backfire, backlash, and back peddling coming soon.
No thanks to FOX so far.

Dupnik talks opinion and it could hurt a federal case.

Or, Dupnik is talking down specifics to reduce the severity of the charges. Could be that he's worried about his own hide, could be he's somehow beholden to a fellow Democrat and employee of Pima County, which would be the shooter's mother.

Deranged commenter:

... this has been a Shot Across The Bow that has, thankfully, shocked the country into finally addressing the violent animosity that has been allowed to run wild and free, not backed up by any facts or real understanding of the problem or the issue- sarah palin put a gun sights target over the districts of congressmen she wanted ousted in 2010? i think that should be a civil law suit against her for the viciousness she's unleashed even on the Repubs who are trying to marginalize her describing them inappropriately with sexual imagery of being "impotent, weak and limp" - this is a nasty miserable woman, not a statesman and deserves NO coverage in the mainstream media

Not only is he wrecking the federal case, He is also setting himself up to be the star witness for the defense by saying that the shooter was unstable and that he was influenced by right wing vitriolic rhetoric.

Soooooo, why doesn’t the Obama Feds go after shooters and killers of Border Control agents with the same gusto as going after nutcase Jared Loughlin?

A dead judge and the Feds are all over it to make sure the shooter is exposed to the maximum charges.

A wounded or dead Border Control agent and the Feds do all they can to accuse the agents and pamper the illegals.

I really believe he’s jealous that he’s been a nobody for 28 years while Sheriff Joe has been in the national spotlight since the day that he took office as Sheriff of Maricopa County. Sheriff Dipstik is the anti-Arpaio. I can already see Dipstik’s book. “America’s Lousiest Sheriff”.

It's the BOTOX. Everybody by now knows that if you use it the way the superannuated Democrats use it the stuff soaks into your brain through your forehead and actually destroys your ability to read at normal speeds or to tell when others are angry at you or displeased with your behavior.

It's just like all the Democrats have become both very stupid and very frozen emotionally.

We need legislation to ban botox and to punish its use.

If this leftie beats the charges he may go on to become a college professor, like his predecessor, Ayerhead.
