The state AG has filed a lawsuit. That will take some time to play out, and in the meantime, Texas is the only state that hasn't submitted their plan, so EPA will regulate Texas emitters on behalf of Texas.

Its really just politics. Perry is planning on running for prez and he wants to be able to run against EPA while his VP candidate, Sarah Palin, runs the attack dog campaign against Obama.

Man, have you got that equation backwards.

First of all, Perry has been adamant that he's not running for president.

Secondly, the American people are not going to give the presidency to another Texas governor for some time to come.

Thirdly, of the several potential candidates, Sarah Palin is the most well-positioned to win the nomination and the general election. She's got no plans to ever take a back seat to anyone again.

For the sake of Texas, and the Union, I hope that Rick Perry faces the EPA down and makes them back off. It'll take some serious guts, but I'm afraid it's gut check time. Someone's got to stand up to the tyrannical over-reach of Washington.
