It is appealable.

when I attended law school over 25 years ago, the first thing I learned in the appeals process is that it does not seek to overturn RESULTS or dismiss evidence unless it can be proven to be "tainted" that was improperly handled and inappropriately granted submission. For any appeal to succeed, it would have to be shown that there was something substantively wrong in the court's procedures, such that it might have changed the outcome one way or another. That means technical incompetence and I seriously doubt it was present in this case. Too many sets of eyes watching from all directions of the political spectrum. This Lieutenant Colonel was brave and incredibly stupid to threaten the livlihood of his family on an unwinnable battle. All I can hope for is that some brave capitalist has agreed to employ him for the rest of his life so that he can feed himself and his family. 'Cuz he's not coming back from something like THIS on his record and expect to make the big bucks in the private sector. He can kiss all of his tri-care benefits buh-bye too and that means the medical benefits for his family are gone along with his commission. As far as the military is concerned, he never existed.

Ummmm. It's "appealable" because Lakin as a commissioned officer was dismissed from service where the first appellate review is automatic to the Army Court of Criminal Appeals, which is automatic unless Lakin waives it.
