The order to deploy is required by statute, and thus also by Articles 90 and 92, to be authorized by a Constitutional President, so that is the order whose lawfulness is undeniably (unless you’re a crooked judge) dependent on a Constitutional president.
As long as that is a charge against him he has the right under the Sixth Amendment to compel witnesses to testify in his defense.
I’m not going to argue about the other charges because this one is so clear-cut. The laws passed by Congress require the President’s authorization.
