In SJ Res 23 Congress gave sole authority to “the President” to decide to use force in the war on terror.

Article 92, the article regarding orders by commissioned officers, says that a “lawful order” must be given by someone properly authorized to give “such an order”.

The orders that Lakin disobeyed were all contained within his order to deploy - a Temporary Change of Station that was to begin by him reporting to KY.

If Joe Biden is the only one who can “act as President” and he didn’t order the 30,000 additional troops, then the brigade commanders were not authorized to issue those deployment orders.

So it is CRITICAL to know which guy is Constitutionally authorized to “act as President” and thus authorized by Congress (in SJ Res 23) to order the use of force. If it’s Joe Biden, then the brigade commanders were never properly authorized to issue those deployment orders, because Joe Biden opposed the surge.

And on what grounds did you determine that Colonel Roberts and Lieutenant Colonel Judd lacked the authority to order Lakin to report to his brigade commander's office, or that Colonel McHugh lacked the authority to order Lakin to report for duty with a unit in Kentucky?
