I’m starting to think that the way to go is to let them pass it — then see if they can enforce it.

That's the same stupid argument that allowed the McCain/Feingold trampling of our 1st Amendment to be passed. It's unconstitutional, but it stands until we can mount a successful litigation effort to overturn it. It is preferable to stop bad law before it is passed. The time and money required to overturn it is astronomical and success is uncertain.
