Joe Miller is contesting at least 10% of all write-in ballots. Misspellings tend to be in the first syllable of Lisa Murkowski's name- some wrote "Mercowski" or "Mircowski."

The law says that the name must be spelled correctly. Either we have a rule of law, or we have chaos.

I cannot favor chaos, personally.

No they shouldn’t.

The whole point of having primaries and having names printed on the ballot is so we can avoid situation where we have to guess who the voter intended to cast the ballot for.

Otherwise why even have primaries? Why not just have one big open write in election on Nov 2nd and forget the whole primary process.

Write-in candidates seriously distorts with the established voting process and hence should be extra penalized and discouraged. People should be elected based on ballots that are certain, not based on ballots that involve any guessing. So that the eventual winner is the one we *know* had more votes, not the now we *guessed* had more votes.

The law of the land is correct spelling - not “intent of the voter”. Miller is trying to have the law correctly enforced.

Why do were even have election law? We’ll just start deciding everything on a case by case basis!

Not according to the law that preexisted the election. The law says that the last name, at a minimum, must be spelled correctly.

Yeah, the “technicality” is called, the election laws of Alaska.

Dems claimed Bush won on a “technicality” too.

The people were told ahead of time that they had to spell it right and they had the option of bringing into the voting booth any materials they wanted.

IOW, they were told ahead of time that it was an open-book test and they would be graded on their spelling.

If they fail that test, they are too stupid to judge who should be Senator.

Alaska Statutes - Section 15.15.360.: Rules for counting ballots. (a)11) A vote for a write-in candidate, other than a write-in vote for governor and lieutenant governor, shall be counted if the oval is filled in for that candidate and if the name, as it appears on the write-in declaration of candidacy, of the candidate or the last name of the candidate is written in the space provided. (b) The rules set out in this section are mandatory and there are no exceptions to them. A ballot may not be counted unless marked in compliance with these rules.

I can relate. My surname is French with one of the more unique spellings to produce the long “O” sound. Most people now don’t even try to pronounce the name, and the spelling-forget it!

I’m not a lawyer but throwing out votes less than perfect spelling is offensive to me. This is common sense. “Mercowski” or “Mircowski” is obviously an attempt to spell Lisa’s last name. There’s no gray area to me.

What's offensive to me is a candidate losing their party's primary then running as a write-in candidate.

What's also offensive to me is giving the same weight to the vote of someone who can't even spell the name of the person they're voting for.

Don't get me started on how offended I am about the tribes bribing or strong-arming their members to write in for Leeza...

Nail biting time - I don’t think I shall survive the 2012 elections.

I’m thinkin’ if BO gets 4 more years - the only upside is that he cannot run again. If he gets thrown out - he could be back!!!!

Hillary would be even worse and could be in the WH for EIGHT MORE YEARS!!!!

You know what’s offensive to me? People who can’t even spell the name of the politician they voted for having their ballot honored when the rules were established before the election the name needed to be correct to forestall a “Florida hanging chad” effect where people “discern” voter intent.

Despite the jokes I’ve made it’s not that hard to learn how to spell the name of the legislator you are voting for. Seems like that should be a minimum requirement when voting.

"Some Miller votes won't count

In another boon for Alaska Sen. Lisa Murkowski, write-in ballots cast for Republican candidate Joe Miller won’t count toward his total vote count. Alaska’s Lt. Gov. Craig Campbell, who oversees elections, told the Associated Press that write-in ballots for Miller will be tossed out.

The write-in ballots are leading in the Alaska race with 41 percent of the vote. Miller has only 34 percent of the vote; Democrat Scott McAdams has 24 percent.

The final outcome won’t be known until all the write-ins have been counted, which could take weeks, but Murkowski is confident of her chances."

"(9) Write-in votes are not invalidated by writing in the name of a candidate whose name is printed on the ballot unless the election board determines, on the basis of other evidence, that the ballot was so marked for the purpose of identifying the ballot."

The Alaskan Lt. Gov. Craig Campbell is dis-obeying Alaskan law, if he tosses Miller write-in ballots that did not identify the ballot as Miller's, but was intended as only a write-in vote.

It isn’t some obscure technicality. It is a rule voters were informed of prior to the leection. Murkowski even ran camapign spots!

I’m sorry if you think the rule of law is an inconvenience but stupidity should not be rewarded.

BTW, Franken manufactired votes. The people who voted for him were not even supposed to be allowed to vote. Don’t dare compare following the rules to what his campaign did.

I believe that issue has already been resolved.

Miller’s write in votes will be counted.

So you oppose the rule of law as it existed before the election? That is what you have said here, as your sentiments are directly opposed to the actual laws in place.
