EPA's Gun Control
IBD Editorials ^ | August 26, 2010 | Investors Business Daily staff

Regulation: The U.S. Supreme Court says Americans have an individual right to keep and bear arms. The EPA says the bullets for those guns may be banned as an environmental hazard.

The endless power grabs by the federal leviathan know no boundaries of law, science or even common sense. The Environmental Protection Agency of Lisa Jackson is seriously considering a petition by the Center for Biological Diversity, a leading anti-hunting group, to ban all traditional lead ammunition under the Toxic Substance Control Act (TSCA) of 1976.

If the EPA approves the petition, the result will be a ban on all ammunition containing lead-core components. Bullets made of material other than lead are often considered armor-piercing by law and are banned. So this amounts to gun control by stealth. Where permitted, it increases the cost of gun ownership and use.

The comment period on this proposed ban has just opened and will last until Oct. 31.

The EPA must accept or reject the petition by Nov. 1, the day before the midterm elections. As if Democrats don't have enough troubles, the Obama administration risks provoking all those townsfolk bitterly clinging to their guns.

There are a couple of problems, the first being that when Congress passed the law it specifically exempted ammunition. So what the EPA proposes to do is illegal. The second is that there is no scientific basis for restricting lead ammunition on the basis of protecting the health of humans or wildlife.

Bingo!!!

Well stated...

When and if the bubble breaks...Everyone loses, whether they are armed or not...

I’m not worried though...I’d rather be an armed loser...

I assume that this would apply to the US military?

Some of EPA's own criminal investigations division agents are armed and probably receiving ammunition purchased in bulk by the agency. You can bet that the ammo vendors who've been doing business with EPA will come forward with copies of the purchase orders.

We should be able to make this very uncomfortable for Lisa Jackson.

wheel weights, car batteries, etc= I got bullets. Used to cast for years, kept all the equipment, not hard to do. Harder materials are banned in handgun ammunition, but not rifle. Bismuth would make a decent substitute, just more costly. Always the legal out-we aren't banning all ammo, just it'll cost you a whole lot more..
Gee, I don't see Obama behind this at all..< /sarcasm>

As word on this gets out, I suppose we can expect another run on ammo. But are the manufacturers ready? I imagine that they’re running the lines hard already.

Am taking bets (though this is a no-brainer for anyone who has seen this Corrupt, Chicago-Thug, Fascist, Regime up close and personal) that IF the EPA chooses to accept this petition, they WILL come up with some excuse to delay their ruling until AFTER the election, as that would gurantee an extra 15-20 seats (LOSS) in the House and 2-3 more in the Senate, for the "Rats!"

The ammo manufacturers shoulkd sue the EPA for restraint of trade and any other provision under the RICO laws that they can and then take it all the way up to the SCOTUS.

In addition to responding to this new rule proposal - a probable exercise in futility, pro-Second Amendment and Constitutionalist Americans should be pressing thier Congressmen to work FAST to head these Bolsheviks off at the pass by adopting a FEDERAL LAW barring the Federal Government from enacting any stricter regulations on lead ammunition than currently exist.

By the time something gets this far in the bureaucracy, you can be ASSURED that that agency is merely going through the motions of seeking public input. They have ALREADY made up their minds.

And stopping this dead with a federal law is the best way to go - NOW while those damn “Blue Dog Democrats” and RINOs are worrying about the November elections.

AFTERWORDS, they will ignore the public AGAIN for two years.

I find it laughable that you think we’ll find adequate relief via the current legal system.

It’s been at least ten years since there were reports of doctors being enlisted by state medical boards to query patients about owning guns.

And if the patient answers “No comment!” and reports that phyzz to the board, his/her answer is then recorded as evidence of uncooperative behavior. Confiscation of patient’s children by state protective services could soon follow.

“Can you trust your Muslim doctor?”

I’m pretty sure the military has been testing non-lead ammo. I’ll try to dig up some articles later.

They will have a tough time finding my kids — I have none!!
However, to have fun with them, I think I will created two or three imaginary kids on my medical form — just to screw with whomever is reading my medical records and report.

"In other words, if they try this, it will be lawsuit time. A slam dunk lawsuit, at that."

It's a huge mistake to put your faith in the courts to protect our rights. I'll put my faith in my fellow Americans and my RKBA. If this happens, it's a definite trigger event.
