The mother of the child should be filing a civil suit against the teacher for damages. A fractured skull and sufficient brain damage to be unable to recall any prior bad behavior sounds like permanent damage. A good "slip and fall" lawyer should be able to win a decent award for the brain damage inflicted.

A good whipping always results in an inability to recall previous misdeeds and from then on the kid behaves very well.
