I think that Obama CAN produce the BC - but whats gonna bite him in the ass is the allegiance component of the “natural born citizen” requirement. THAT is what he is scared of ...
Assuming that AZ passes the law, there is NO way that the State SOS can certify that he is natural born - since it is NOT explicitly stated in the Constitution, NOR has it been specifically ruled upon by SCOTUS.
The logical thing for the State SOS to do would be to deny Obama. It would then be up to him to go to court.
Since this is an issue of national importance, and because it would inevitably reach SCOTUS at some point - they will probably HAVE to “man-up” and take the case immediately under original jurisdiction. No more hiding behind the skirts of their robes citing “lack of standing”.
SCOTUS would then be faced with a difficult choice - either rule that ALL children born in the United States are natural born [regardless of parentage or allegiance], subject to the exceptions for ambassador’s children, etc., or rule Obama NOT to be natural born.
If they rule that all children born in the United States are natural born - they open a door for a possible “agent provocateur” that the Founding Fathers were afraid of ...
If they rule Obama NOT to be natural born - they lay the groundwork for a possible Constitutional controversy and possible civil unrest.
Having read the applicable law at the time of the writing of the Constitution - I believe there would be btter than a 50-50 shot that he would be declared ineligible, BUT SCOTUS would rule that remedies could NOT be applied retroactively ...
