I'm not referring to anything in the bill. I am referring to Title 42, Section 209 of the United States Code. Sec. 5210 of the "Patient Protection and Affordable Health Care Act" amends Title 42, Section 204 of the United States Code, and leaves Section 209 unchanged. Both sections are part of Chapter 6A of Title 42, which establishes and governs the Public Health Service. You can find the text of 42 U.S.C. 209 here.

AS AN ARMED, DEADLY FORCE LAW ENFORCEMENT is ridiculous, aluminum-foil-hat crazy.

If Obama had not put the hate crimes bill in the defense bill because he knew on it's own it would not pass, then I would say you might be right.

If Obama had not put nationalizing education loans in a healthcare bill because he knew it would not pass on it's own I would say you might be right.

If Obama had not signed E.O's sneakily without a word as to why he did so...

Had he not signed a EO giving Interpol more power than our FBI...

Obama is installing rule of law in hidden ways so no one notices. This HCR bill was never to be read in full because of these types of hidden legislation to benefit Obama's agenda. Some of his EO's we still have no answer on. They sit there waiting for his next power grab. I don't want to wake up one morning with Obama thugs at my door. I will stay vigilant.

You’re hardly alone in that - it’s certainly easy to view that as ominous when it is taken out of context. The United States has seven uniformed services, and the PHS is the least well-known of them. The text of the bill referred to in this thread amends one section out of the literally hundreds of sections of the United States Code which govern the PHS.

He mentioned a civilian security force, if I remember correctly. This bill alters a “force” that is neither civilian nor involved in security.

Yes he did. But before we all go nuts and make fools of ourselves- we need to get some answers from our congress on what this actually means.

I REACTED- as I tend to do lately because nothing this gang does would surprise me. We need to find out what this REALLY means. Is there anywhere in this section that mentions this corps being armed? Having the power to arrest citizens? It’s possible this is more job-making nuttiness- bad, stupid and unsettling- but not Brownshirts.

I’m trying to stay sane and get facts.

"The Track" AFAIK appears the euphemism for "medical student loan program". Still examining.

Please ping me if you or anyone finds out more. Our kids are going into pre-med and pre-pharm. We're looking at a few fed loans and have to decide in a couple weeks to accept them or not. If this is the case, I'd rather mortgage the house than get them mixed up in this. The house won't be enough but we'll cross that bridge when it comes. Wonder if it'll be retroactive.

hmm, I don’t see where it is just a medical corp in the wording...remember, if it isn’t a specifically given federal power it is a federal power /sarc but sadly true...

Found some info ... this doc is dated 2/07. That was the timeframe when the bird flu fears were sweeping the world.

CREATING A U.S. PUBLIC HEALTH SERVICE READY RESERVE

The Public Health Service (PHS) Inactive Reserve Corps (IRC) comprises physicians, dentists, environmental engineers, nurses, and specialists in allied professions who can provide essential surge capacity in response to any threat to national security. The substantially increased threat that terrorists may use biological, chemical, and radiological agents against America highlights the need to assure the viability of the PHS Inactive Reserve Corps.

The IRC is a component of the Public Health Service Commissioned Corps (PHS) in the Department of Health and Human Services (DHHS). PHS commissioned officers upon leaving full-time Active duty status may elect to serve in the IRC. The IRC has no provision allowing for monthly training (drills) or annual training in the traditional model of a U.S. Reserve or National Guard Component. Current regulations allow direct recruitment and commissioning into the IRC. However, with no incentives, commissioning into the IRC is seldom done.

IRC officers are at all times subject to voluntary call to Active duty and, when on Active duty, receive the same pay and allowances as their counterparts on Active duty in the regular PHS Commissioned Corps. In addition, the president by executive order can militarize the PHS Commissioned Corps, authorizing involuntary activation of the Inactive Reserve Component in times of threatened or actual war. Public Health implications of the nation’s homeland security threat, mandates a Public Health Service surge capability to respond to emergencies that threaten the security of the nation and its citizens. This surge capability is constrained by their limited Reserve structure.

A lack of parity with Department of Defense, National Guard, and Coast Guard Reserve benefits and protections, such as re-employment rights and non-regular retirement credit, serves as a deterrent to continued service in a Reserve capacity for officers who separate from full time duty. Members of the PHS IRC do not receive standard or specialized training required to maintain currency in treatment and/or response to biological, chemical, or radiological medical emergencies.

The current legislative authority and organizational structure of the U.S. Public Health Service’s IRC needs to be strengthened to provide the Secretary of Health and Human Services the necessary capability to recruit, maintain, and deploy Reserve Component officers in times of national public health crises. Establishing a Public Health Service Ready Reserve Officer Corps to provide sufficient surge capability for national security and other public health contingencies is now a necessity.

ROA urges Congress to establish a Public Health Service Ready Reserve Officer Corps as well as an Inactive Ready Reserve entitled to the same benefits (paid training, retirement, re-employment rights, leave, etc.) as members of the U.S. Armed Forces Reserve and National Guard Components.

That’s because it only amends one section of an existing chapter (Title 42, Ch. 6A) of the United States Code. Those three pages in the bill do not comprise the entire body of law that will govern this “Ready Reserve Corps” of the Public Health Service.

See post 146. It sounds like this is an expansion of an existing program of military doctors, nurses and other health specialties. We would have to track back through the bills, but from what I can tell, this may be muchado about nothing...not that Obama won’t try to turn it into something bigger. That’s why we probably need to take the time to track this back through the bills that they refer to etc. to be sure.

Right now, I am working on a little ‘investigating’ of the whole coordinated attack from the democrat party on the Tea Party. There is something very sinister going on with all of these so called reports and it’s not coming from the TP.

SEmom...there are some very wicked people pulling the dem strings right now and I am truly a bit frightened at the organized way that they and the media are going after us.

You are viewing this with 20/20 hindsight of history. Until AFTER the Allied Forces conquered the Concentration Camps, people denied they were anything but grand! Even had a really nice one in Switzerland that Hitler would have a Nazi soldier film them (jews) all healthy and playing ball. Like they were just living it up in the sunshine. Of course that was a minute amount of people, the rest were being murdered. I suggest you watch the documentary “Steal a pencil for me”, that will give you an idea.

And even AFTER the liberation, our Generals were so terrified that people would NOT BELIEVE him at how horrific the camps were, and how staggering the deaths were, that he made the soldiers film them burying the thousands and thousands of dead that was just laying around.

So, I’m sorry, but I don’t believe you when you say that you would have killed an SS soldier. You would have been just like all the Germans who told themselves that Hitler wouldn’t, Hitler COULDN’T be THAT bad!

By the way, I agree that the establishment of the Public Health Service, as it exists today, is probably unconstitutional. The general public health is beyond the scope of the Constitutional responsibilities and powers of the federal government and are more properly part of the general police power, which ought to be and traditionally were reserved to the states. The PHS’s predecessor, the Marine Hospital Service which was established during the Presidency of John Adams, was more appropriate as it was within the scope of the federal government’s maritime responsibilities.

However, as violations of the doctrine of Enumerated Powers goes, this is a relatively harmless one.
