I have said for years, that the Republicans have been hiding behind Court decisions, that gave them cover for their real agenda. This issue, will be proof positive of their real intentions for our Republic.
Congress has the Authority to pass laws, not subject to Judicial review, but the Republicans avoided that option like the plague. They can also limit the Jurisdiction of all inferior courts, but they avoided that also, and in my opinion they did so because the courts were doing their bidding, and providing cover for the Progressives.

How dangerous will Juan be if he (as I hope) loses to JD? Will he quit pretending to be a conservative and feel himself free to go back to his old self, becoming the 60th vote to break filibusters? If he does, the Dems could pass a lot of legislation this year, including cap'n trade, immigration (which Graham has co-sponsored), financial reform and so on.
Voting the bastards out may not be enough after this year is over.
