I’m curious about your sources on these counts. So far my count is 10 AGs that are publicly on record or have their state legislatures ordering them to sue - Texas, Florida, South Carolina, South Dakota, North Dakota, Nebraska, Utah, Washington, Pennsylvania, and Idaho.
Not that I doubt that a lot more than 10 will be involved eventually. I’m just wondering if you three have heard of any more states for sure.
Also, 36 states is actually more than enough to call a constitutional convention - only 2/3rds, or 34 states, are required to convene a “convention for proposing amendments”, while 3/4ths, or 38 states, are required to ratify an amendment. I wonder if there are 34 state legislatures willing to get on board for such a thing....
Boehner remarked on the house floor last night that 27 or 28 (I’m don’t remember exactly which now, I heard both through the course of the day) states were preparing constitutional challenges and said, “That’s enough for a constitutional amendment.”
