That's precisely why they will have to get involved. If Pelousi uses the “Slaughter” maneuver, it makes it even easier to strike down. One way or the other we are going to go after this bill.
SCOTUS ruled for Nixon to release tapes he had had made by executive decision. If this becomes a matter of a clear violation of Art Seven SCOTUS will rule. Precedent is on the side of Pelosi since this stuff has been done before. But SCOTUS may say that prior bad acts do not validate a current bad act.
They will if a large number of people refuses to buy insurance, and is threatened with being put in jail—or even does go to jail. THAT would be in clear violation of the Constitution.
They struck down campaign finance reform.
If a bill is clearly unconstitutional I don't think the separation of powers is going to make a difference.
Ironically, the Executive Branch and Pelosi and Reid are joined at the hip on this.
